You can hire an employee in Norway without incorporating a Norwegian company, provided the employment route and local obligations are in place. Direct employment by your overseas company is a supported route through Norwegian registration. An employer of record (EOR) can be another route, but the actual arrangement may fall under Norway’s restrictions on hiring labour from staffing enterprises.
Start by deciding who will legally employ the person and whether that arrangement is permitted. Then work backwards from the first salary date. A signed service agreement alone does not establish readiness. The sequence below addresses ordinary mainland employment.
Can you hire an employee in Norway without incorporating?
Yes. A foreign business needing a Norwegian organization number registers as a Norwegian-registered foreign business, or NUF. The overseas company remains responsible for the Norwegian operation. This registers the existing foreign business rather than incorporating a separate Norwegian subsidiary. See the registration authority.
The distinction matters: avoiding incorporation does not mean avoiding registration. Business operations in Norway require registration in the Register of Business Enterprises; businesses needing an organization number without conducting business operations can register in the Central Coordinating Register for Legal Entities. Determine the correct register from the actual activities.
Corporate tax is another assessment. Altinn’s NUF guidance requires a case-specific tax assessment. Payroll registration does not settle whether the business has a taxable permanent establishment.
Choose a permitted employment route
| Route | When available | Who is the legal employer | What must be in place |
|---|---|---|---|
| Direct foreign employment through NUF registration | Your company accepts Norwegian employer duties and completes the applicable registrations | Your overseas company | Organization number, appropriate register entries, employment terms, work rights, insurance and payroll/reporting access |
| EOR arrangement involving labour hire | The actual assignment has a lawful hiring-in basis and the supplying employer is authorized | The EOR named in the employment contract | Provider authorization, documented assignment basis, equal-treatment inputs, work permission and employer administration |
| Norwegian incorporated company | Your business chooses a separate Norwegian employer | The Norwegian company | Incorporation and employer setup; outside this article’s no-incorporation objective |
Norway assesses the substance of labour supply, including who directs the work. An EOR label does not create a separate exemption. Under the Working Environment Act, section 14-12, permitted grounds include replacing an absent employee. A separate route allows time-limited hiring where the client is bound by a collective agreement with a union having nomination rights, requiring at least 10,000 members, and has a written hiring agreement with representatives covering a majority of the relevant employee category.
There are narrow exceptions for specialist advisory or consultancy work, supplying expertise the client lacks within a clearly defined project, and certain healthcare needs. An indefinite position is not converted into a defined consultancy project by changing its title. Check the staffing regulations.
A payroll processor can administer your direct employment, but does not thereby become the employer. Contractor status also cannot substitute for employment where the person works in a subordinate employee relationship. The Labour Inspection Authority explains the classification distinction.
Confirm the person, job and work location are eligible
Before making an unconditional offer, establish:
- Work rights: Check citizenship or the actual residence-permit conditions. An EU/EEA employee can generally start work immediately and must register within three months of arrival when staying longer than three months. Other permit categories require their own checks. See UDI’s employee rules.
- Role and contract: Permanent employment is the normal rule. Temporary direct employment requires a permitted basis; testing a market is not itself a temporary-employment category. See temporary employment.
- Actual worksite: Hiring-in from staffing enterprises for construction work on construction sites is prohibited in Oslo, Akershus, Østfold, Buskerud and Vestfold under the staffing regulations. The restriction concerns actual construction work; office roles require their own assessment.
- Employer and assignment: Check the exact supplying legal employer in the authorization register. Authorization alone does not prove your assignment is permitted.
- Professional permission: Identify any required recognition or authorization, particularly for regulated work.
For a skilled-worker permit through a staffing agency, UDI requires planned assignments confirmed by the receiving businesses, with permission limited to the listed assignment period. Its separate foreign-company assignment category has different requirements. Use the correct skilled-worker category.
A useful stop condition is an ongoing role under your direction with no established lawful labour-hire basis. Pause that EOR route and assess direct foreign employment. If the worker needs a new permit, resolving the employer route does not itself authorize work.
Prepare the offer and country employment terms
The legal employer prepares the employment agreement. Use language both parties understand; the Labour Inspection Authority provides templates in several languages. Complete signatures before starting as an operational safeguard.
| Decision or document | Required information | Responsible party | Deadline or dependency |
|---|---|---|---|
| Employment agreement | Parties, workplace, duties, start date, permanent or permitted temporary status, probation, notice, applicable collective agreement | Legal employer and employee | For employment exceeding one month: as early as possible, within seven days after commencement; labour hire and short employment: immediately |
| Pay and working time | Gross salary, separate supplements/benefits, payment interval, hours, breaks, overtime arrangements, holiday and holiday pay | Legal employer; client supplies role inputs where relevant | Include in the written terms |
| Regular home-working agreement | Extent, hours, availability and equipment arrangements | Legal employer and employee | Complete before the agreed home-working arrangement begins |
| Identity and permission file | Identity, applicable work rights, any professional authorization | Worker supplies evidence; employer checks | Before relying on eligibility to start |
| Payroll file | Identity number, bank details, start date, salary, tax-card retrieval and reporting access | Worker, employer and payroll administrator | Before first payroll processing |
The contract requirements apply to foreign employers too. The seven-day period is not a suggested waiting period. The additional home-working regulation applies to work in the employee’s own home, with scope exceptions for short or sporadic work unless the employee works only at home.
For direct registration, obtain recent home-country registration evidence, generally no older than three months. Business-register registration also requires founding documents and a corporate decision establishing the Norwegian operation. New foreign-business registration uses a dedicated form, rather than Altinn’s electronic registration form. Follow the registration instructions.
Check the role-holder requirements, including Norwegian identity numbers or D-numbers where required. A separate resident representative is not a universal payroll requirement; VAT-related representation has its own conditions.
Complete the hire from agreement to first payroll
Consider a hypothetical overseas software company hiring a 35-year-old Norwegian citizen, resident in Oslo, permanently and full time to maintain its own product from home. The employee has no ownership interest, works only in Norway and belongs to Norwegian social insurance.
The overseas software company is the legal employer through its NUF registration. Assume its register entries, sub-entity number and tax assessment are completed before Friday, 13 November 2026. No customer assignment is involved. The target start is Monday, 16 November, with first salary on Monday, 30 November. These are example dates, not a registration-time promise.
- Approve the route. Company leadership records direct employment and the register/tax decisions. An NUF in the Business Enterprises register must report beneficial ownership within two weeks of registration. Assume any such filing is also completed before this hire starts. Retain registration, filing and approval records.
- Finish the documents by 13 November. Employer and employee sign employment and home-working agreements. The worker supplies identity and bank information; HR records the citizenship check.
- Arrange protection and payroll access. The employer obtains occupational injury insurance, retrieves the tax card and confirms reporting permissions. It establishes a pension arrangement effective from the start.
- Release the start gate on 16 November. HR checks the documents and coverage; the manager completes equipment and safety induction. An unresolved work-right or required-coverage issue prevents release.
- Approve payroll inputs by Thursday, 19 November. The manager confirms the agreed first-period gross pay and any changes. Payroll produces a calculation for employer approval. This cutoff is an assumed commercial arrangement.
- Fund and pay. Finance makes cleared funds available by Thursday, 26 November, under the assumed payroll arrangement. On 30 November, the employer pays net salary and supplies the payslip.
- Remit and report. Payroll pays withheld tax by Tuesday, 1 December. It reports November employment and pay by Monday, 7 December, because 5 December is Saturday. The employer’s November/December social contributions fall due on Friday, 15 January 2027.
These are separate clocks: withheld tax is due by the next working day; the a-melding deadline is normally the fifth of the following month. Employment reporting continues monthly even without salary, and the first ordinary a-melding establishes the relevant Aa-register records.
| Milestone | Must be complete | Evidence | Who confirms |
|---|---|---|---|
| Start: 16 November | Route, work rights, signed terms and agreed protection | Registration, eligibility file, contracts, insurance and pension confirmations | Employer HR |
| Payroll approval: 19 November | Correct first-period earnings and deductions | Approved payroll calculation and tax-card record | Manager and payroll |
| Funding: 26 November | Salary funds and scheduled tax liquidity | Cleared balance and payment instructions | Finance |
| First salary: 30 November | Net pay delivered and payslip issued | Bank confirmation and payslip | Employer/payroll |
| Follow-through | Tax by 1 December; a-melding by 7 December; contributions by 15 January | Payment receipts and accepted reporting feedback | Payroll and finance |
Under these assumptions, the employee starts on 16 November and receives the first salary on 30 November. If registration or another agreed start dependency is unfinished, the employer must resolve it and agree a revised start before work begins. A funding failure after work starts does not move the contractual payday: finance must arrange payment. A missed filing is an employer correction issue, not permission to defer wages.
Budget and prepare the first payment
Agree the payday in the employment contract. Norwegian law defaults to salary at least twice monthly unless otherwise agreed; the example expressly assumes monthly payment. Salary is paid to the employee’s account, with a statement showing its calculation and deductions under the payment rules in section 14-15.
| Cost layer | What to price | Timing |
|---|---|---|
| Gross earnings | Salary, overtime, taxable benefits and agreed supplements | Each payroll |
| Employer social contributions | Applicable zone, activity and social-insurance position | Accrue with payroll; ordinary payment every two months |
| Holiday pay | Applicable earnings basis and entitlement | Accrue now; payment follows holiday-pay rules |
| Pension and injury insurance | Pension premiums, administration and insurance quote | Recurring; coverage and accrual from applicable dates |
| Administration and conditional charges | Payroll or EOR fee, registration, equipment, advice and any permit costs | Separate recurring fees from one-time charges |
Foreign employers without a Norwegian registered business address generally use a 14.1% employer contribution rate; applicable zones and valid social-insurance exemptions can change the result. The foreign-employer guidance also sets out the two-month payment schedule.
For the example, assume agreed November gross earnings of NOK 30,000 and a confirmed 14.1% rate. Contributions on that salary alone are NOK 4,230. This excludes pension-related charges, holiday-pay accrual, insurance and administration. Net salary depends on the worker’s actual tax card; employee withholding is part of gross pay, not another employer cost.
Holiday pay is ordinarily at least 10.2% of the qualifying prior-year earnings basis, with higher rates for relevant agreements and older employees. It replaces pay during leave; do not automatically add it to twelve unreduced monthly salaries.
One full-time non-owner employee triggers the pension-establishment criterion. The OTP rules require at least 2% pension saving on the statutory pensionable salary basis, with eligible employees covered from their first day. A new scheme must be established within six months of the obligation arising; the example chooses earlier completion.
For broader budget planning, see our Norway hiring costs. Obtain a case-specific quote and fund both payday and the next-working-day tax transfer.
What your company still manages after the hire
Keep a named owner for:
- Daily work, hours, overtime, leave and safe working conditions.
- Payroll changes and approvals before the agreed cutoff.
- Changes in duties, work location or commercial authority that require renewed immigration, registration or tax assessment.
- Access to employee information, equipment and business systems.
- Any professional or sector authorization needed for the actual activity.
With an EOR, give the employer the pay and working-condition inputs needed for equal treatment. The client also retains working-time and workplace responsibilities, and can face liability for unpaid remuneration. These duties are explained in the labour-hire guidance.
Where a foreign contractor performs a reportable Norwegian assignment, the client reports the assignment and the contractor reports the workers through the assignment register. That is a separate check from ordinary payroll reporting.
Questions about hiring without an entity in Norway
Can headquarters outsource Norwegian payroll administration?
Yes, while remaining the direct legal employer. Assign reporting permissions, tax-card retrieval, payment execution and error correction explicitly. A payroll contract alone does not transfer the employment relationship.
Is an authorized EOR enough to start the employee?
No. Check the assignment’s lawful hiring-in basis, work rights and employment readiness separately. Provider authorization resolves only one part of that assessment.
Can we sponsor someone through the same route?
Do not assume so. UDI’s employer, role and assignment requirements depend on the permit category. An already authorized Norwegian resident and a person requiring a new work permit need different onboarding decisions.
Must the first a-melding be accepted before day one?
Ordinary monthly employment reporting is due after the reporting month. In this example, readiness means the employer has the identifiers, data and access to report correctly; November’s filing is due on 7 December.
Can a missed commercial cutoff postpone wages?
The cutoff is an administrative arrangement. Once employment starts, the employer must meet the agreed payment obligation, using a corrected or additional payroll process where necessary.
Borderless AI’s EOR service includes employment contracts, payroll and benefits administration. Bring the person’s work-right category, job description, worksite and proposed start date to an arrangement assessment. Confirm the employing party and Norway-specific eligibility before treating an EOR proposal as ready to execute.
