Convert an existing Swiss contractor by agreeing employment terms, settling existing rights and coordinating supplier exit with confirmed employee readiness. Then verify first payroll and the later declarations/payments.
Swiss priorities are insurance continuity, service and IP treatment, and cantonal payroll-tax administration. The Zurich calendar separates start prerequisites from later financial closeout.
Rules checked 19 October 2026.
What changes when a contractor becomes an employee in Switzerland?
Record final contractor service, employee start, recognized service and first payday in one cutover plan.
Changing the label does not settle the earlier relationship. The compensation office assesses AHV status for the actual activity; independent work for other customers does not establish independence for this engagement.
Establish status, work rights and the employment route
Identify the actual supplier and review how the work operated. Possible historic employment changes the contribution, leave and service assessment before the proposed cutover.
Verify nationality, permit and proposed employee job. SEM's mobility guidance allows an EU/EFTA national moving from Swiss self-employment to salaried employment to retain their EU/EFTA residence permit. This covers the example's German B EU/EFTA holder; other B permits, local record updates and regulated work need their own check.
- Swiss direct employer: use the entity's employer accounts, pension arrangement and accident insurer. Confirm first-worker readiness even if the company already exists.
- Direct foreign employer: a social-insurance route exists, with rules depending on employer domicile and worker nationality. Registration alone does not resolve Swiss tax presence, immigration or insurance.
- EOR arrangement: establish the actual Swiss employer and worker eligibility. Commercial leasing needs cantonal permission, with additional SECO permission for cross-border activity. SECO prohibits direct and indirect foreign-to-Swiss labour leasing. A foreign supplier's global EOR offer or services notification does not override that prohibition.
Agree the offer, start date and treatment of existing rights
Agree the package before supplier exit. For indefinite employment or a term exceeding one month, the written-information duty covers the parties, start, function, salary/supplements and weekly hours within one month after commencement. Target signing before start.
Confirm the handoff before ending supplier service
Agree a written conversion record with the prospective legal employer, including an EOR's acceptance of this worker, job and Swiss arrangement:
- Your company supplies the actual supplier agreement, contracting party, notice/consent terms, proposed last service, final invoice/expenses and existing deliverable/IP records.
- The worker supplies identity, permit, AHV number, residence and payroll facts, plus existing coverage information.
- The prospective employer confirms accepted terms, service/probation and rights treatment, employee work permission, pension/accident coverage, accepted payroll inputs and the employee start date.
Name registration, payment and evidence owners under this arrangement. Obtain written start-readiness confirmation before irreversible supplier termination; assign later obligations separately.
Federal holiday minimums, 45 or 50-hour maxima for covered categories, canton and collective terms frame the offer. Zurich city's minimum-wage commencement remains open; its advertised rate is not yet operative.
Ordinary indefinite employment has a one-month probation default; written changes ordinarily cannot exceed three months. Conversion does not authorize an existing employee's probation restart. For qualifying employment lasting, or entered into for, more than three months, the statutory first-year salary-continuation floor is three weeks. Check eligibility, equivalent insurance and waiting-period funding.
Ordinary copyright generally begins with the creator, including an employee. Qualifying employee software has a special employer-use rule; inventions and designs created in contractual duties have a separate Article 332 rule. Verify contractor-era grants and obtain missing rights separately; employment does not transfer those deliverables. If the EOR employs, agree how future rights pass to your company.
Compare the old invoice with the employee package
Assume the contractor bills CHF 9,000 for eleven months, with one unbilled month: CHF 99,000 annual revenue before their own costs. The employee proposal is CHF 96,000 annual gross, paid across twelve months, with four weeks' paid holiday. The CHF 3,000 headline difference does not establish a take-home reduction; reconcile work patterns and expenses.
All figures are illustrative and exclude VAT and reimbursed expenses. There is no universal conversion ratio.
The 2026 AHV rates and ALV rules support this limited subtotal. CHF 7,488 after those two employee deductions is not net pay. Calculate source tax from applicable taxable gross and the verified tariff, not the CHF 7,488 subtotal. Other deductions remain plan-specific; identical take-home is not promised.
Complete the country conversion steps
- Agree the conversion record. Your company, worker and prospective employer complete the handoff above, including status, permission, terms and accountable owners.
- Arrange supplier closeout. Procurement checks the actual agreement and secures notice, consent or mutual termination as required. Agree final service, deliverables, invoice and expense treatment, conditional on confirmed employment readiness.
- Confirm employer accounts and coverage. The legal employer verifies AHV affiliation, family-fund membership and insurance admission. The example meets mandatory pension scope; its 40-hour week requires both accident branches. Accident coverage begins with employment or salary entitlement, at the latest the journey to work.
- Complete payroll inputs and entry reporting. Payroll verifies permit, residence, civil status, dependants, church, other employment and AHV identity. An existing AHV number normally permits employee reporting with annual wages; without one, request it within 30 days. Obtain the Zurich SSL employer number and submit the source-tax entry notice within eight days, or use the permitted monthly electronic-reporting alternative.
- Start employment and run first payroll. HR confirms that the agreed terms and coverage are active. Payroll applies the verified tariff/deductions and delivers the written payslip; finance confirms the salary bank credit.
- Finish scheduled declarations and payments. The employer's payroll/finance owners obtain accepted returns and separate payment receipts through the dates below. If an EOR employs the worker, agree the evidence it provides and the client's funding/input obligations; confirm the allocation in that agreement.
- Reconcile both engagements. HR and procurement close outstanding supplier items; the employer reconciles payroll, certificates and statutory accounts. Keep any historical-status correction separately documented.
Worked Zurich cutover
Assumptions: Zurich-city GmbH, first worker; locally resident unmarried German, age 35, valid B EU/EFTA permit and AHV number. Indefinite nonregulated office/software job; no collective agreement assumed. Agreed terms: CHF 8,000 × 12, 40 hours/five days, waived probation and full November salary. Annualized payroll CHF 96,000; quarterly AHV advances, monthly source-tax returns; December payday 31 December.
The legal employer and its payroll team own this example's administration. For an EOR conversion, confirm provider responsibilities and required client inputs. Assume mutual supplier exit, personal accident cover through 1 November and calendar insurance years. Invoice dates and insurer deadlines are hypothetical document terms; substitute the actual documents.
The accident ordinance gives one month after premium maturity and lets the insurer set year-end wage-reporting dates. The accident statute requires annual advance premiums and settlement of an additional premium within one month after invoicing. The pension payment rule sets the outer limit; earlier scheme invoices still govern. Pension and certificate internal targets remain distinct from legal limits.
Zurich source-tax returns are due within 30 days after the selected monthly period; payment follows the authority invoice. AHV collection rules separately govern quarterly advances, annual wage reporting and reconciliation. These later obligations remain scheduled after start.
The canton administers federal/cantonal/municipal source tax. Zurich's training fund is a separate employer levy, but payroll below CHF 250,000 is automatically exempt. General municipal company taxes concern profit/capital rather than an additional general employer wage tax. Reassess sector/local scope if facts change.
Close the contractor engagement and verify first payroll
Supplier file: retain the contracting party's notice/consent, final acceptance, invoice and payment record; settle expenses/disputes; complete missing IP grants and equipment/access/data handover. Reconcile the service periods so the same work is not paid twice.
Employment file: compare the signed package with the first payslip's dates, gross/variable pay, employee deductions and net bank credit. Match the calendar's accepted reports and paid invoices to the employer's accounts. Deliver the annual salary certificate, including source tax, after year-end. Annual AHV reporting does not replace it.
Two conversion situations to plan for
A planned full-time conversion. The worker has the valid German B EU/EFTA permit described above. The prospective Swiss employer accepts the package and old-IP arrangements, confirms 2 November readiness and returns the coverage confirmations. Your company agrees 31 October as the final service day only after that confirmation. Existing cover protects 1 November; later settlements stay with the named owners.
A six-hour weekly conversion. Keep the person and location, but reduce the agreed job to six hours weekly with this employer. The eight-hour threshold changes the insurance action: this job supplies occupational/commuting accident protection, not non-occupational protection. HR must explain that difference and verify separate leisure-accident cover before the worker cancels existing protection. The full-time example's pension and payroll assumptions must also be recalculated.
Questions about converting contractors in Switzerland
Can we convert without forming a Swiss company?
A qualifying direct foreign-employer or lawful Swiss EOR route can work, subject to eligibility. Our Switzerland guide explains that broader arrangement.
Can the final contractor invoice be paid after employment starts?
Yes, where it covers earlier services and follows the supplier agreement's payment terms. Record the service period, acceptance and payment date separately from employee salary.
Does contractor tenure automatically become employee service?
Contractual service credit is negotiable; statutory treatment depends on the actual past relationship. Settle that basis before recording opening balances.
Can the worker keep invoicing while payroll is being arranged?
Only if the actual relationship and permission support contractor work. Missing paperwork does not prevent employment arising from the working facts. Re-plan the cutover if employee readiness is incomplete.
