For permanent employees you intend to manage directly in Belgium, examine direct employment first: either register your existing foreign company as an employer or establish a Belgian entity. An employer of record arrangement needs a separate legal feasibility check before its fee becomes useful.
Belgian law generally prohibits supplying employees to a client that exercises employer authority over them, outside permitted arrangements. Article 31 makes the actual relationship decisive. A provider's employment contract and payroll registration do not, by themselves, establish that your intended management model is permitted.
Decide who directs the work and what your Belgian operation must do before comparing fees.

Which route fits your plans in Belgium?
A small Belgian team does not automatically require either an EOR or a subsidiary. The federal employment authority explicitly recognizes permanent foreign employment, separately from temporary posting. Your existing company can remain the employer, subject to the applicable registrations and obligations.
A qualified agency can supply infrastructure for a genuinely eligible temporary assignment. An entity instead gives the group a local legal vehicle for its own operation. These are different operating cases; an attractive monthly fee cannot make one substitute for the other.
Which employment routes are available?
Test authority, purpose and duration separately
Under the official guidance, safety instructions are distinguished from other directions. Additional instructions require a detailed written agreement, matching practice and preservation of the actual employer's authority. Applicable employee-representation information duties also matter. A contract clause cannot repair a working relationship that contradicts it.
Ask who approves leave, controls performance and takes employment decisions. Outside the lawful agency framework, prohibited supply can expose the user to an indefinite employment relationship and joint payment and contribution liability. The applicable liability regime depends on the actual arrangement.
Temporary agency rules allow specified reasons, including replacement, temporary increases in work and exceptional work. Approval is regional. The Flemish EOR guidance expressly addresses client authority and agency recognition. It also requires separate recognition for agencies working in Brussels, Wallonia or the German-speaking area. Check both the relevant approval and the assignment's statutory basis.
There are also limited lending exceptions. Article 32 is exceptional: lending cannot be the supplier's normal activity, concerns its permanent staff and is limited in duration. Required authorization or notification depends on the case. It is unsuitable as a blanket explanation for a business that routinely supplies workers to clients.
Keep direct foreign employment visible
The WIDE service identifies employers with the National Social Security Office, or ONSS/RSZ, and expressly includes a foreign-employer code. Registration identifies the foreign company for employer filings; it does not create a Belgian subsidiary. A payroll agent can assist while your foreign company remains responsible as employer.
What each route requires your company to manage
An SRL, called a BV in Dutch, is a private limited company. The government's company-form guidance requires sufficient initial resources backed by a financial plan and a notarial deed. A low stated contribution is not evidence that the operation is adequately funded.
For an entity, employment readiness follows incorporation. The official registration sequence covers banking, the deed, enterprise registration, beneficial ownership, VAT where applicable and employer registration. Beneficial owners must be registered within 30 days of incorporation. Assign each dependency before setting a start date.
ONSS registration, Dimona notification no later than work begins and quarterly DmfA reporting are separate tasks. Private-sector employers also need accident insurance from the first working day. Establish payroll-tax filing and payment responsibilities separately from social-security reporting.
Budget ongoing accounts and filings. The National Bank describes annual-account filing obligations for most legal entities. The company also needs an appropriately funded financial plan; the operating horizon should inform its cash requirements.
Sector classification can change the employment package. Joint-committee guidance looks principally at the employer's actual Belgian activity, with exceptions and distinctions between worker categories. A sales role in a manufacturing business does not automatically belong to a retail committee. Check classification under each proposed employer before treating benefits as identical. Our Belgium employment guide covers the wider contract and workplace obligations.
Separately assess permanent-establishment exposure. FPS Finance explains the distinction between an overseas business and profits attributable to a Belgian permanent establishment. Apply the relevant treaty and operating facts; using an employment intermediary does not settle that analysis.
Compare costs on the same basis
Use one employee specification across routes. The examples below assume ordinary private-sector white-collar roles, Belgian social-security coverage, existing permission to work, constant headcount and €5,000 monthly base salary paid twelve times annually. The €60,000 annual base is an illustration, excluding additional employment payments.
Hold the same required and agreed package constant: employer contributions, holiday-related payments, applicable bonuses, benefits and accident-insurance premiums. Verify sector and provider-specific differences separately. None of these employment amounts is included in the route-only totals. Our Belgium hiring-cost guide addresses that separate budget.
What local prices establish, and what they leave open
A3RT's accounting tariff starts at €280 per month excluding VAT for an active SRL, covering accounting, VAT declarations, corporate tax and the director's personal return. International activity and company groups require a bespoke quote. This starting price does not establish an employee-payroll, employment-advice or all-in operating-company budget.
The National Bank's 2026 filing totals are €67 for a micro XBRL account and €89.40 for an abbreviated XBRL account. Select the legally applicable model. These are filing charges, not preparation fees. Confirm whether an accountant's quote already includes them before adding them again.
Those evidenced components do not validate the worksheet's €600 monthly external company-support allowance, €60 per-worker service charge, setup or closure budgets. All remain replaceable assumptions. Employer-registration procedures are free when self-filed; purchased administration is different. Request a scope covering accounts, tax returns, group reporting, payroll, corrections, benefits administration and exit. All modeled amounts are euros, excluding common employment costs, financing, inflation and recoverable VAT; add unrecoverable taxes.
Three headcount and time-horizon scenarios
The figures below are replaceable illustrations, not evidenced Belgian operating budgets or market break-even points. They use permanent, client-directed roles and no qualifying worker-supply exception. A standard EOR with transferred employer authority is therefore unavailable for these cases. A different lawful arrangement needs its own feasibility assessment and quote.
Entity route expense equals €5,000 setup + months × €1,000 fixed overhead + employee-months × €100 administration + €3,000 administrative exit.
If the entity continues beyond the horizon, remove the assumed closure expense and budget its later exit separately. If employment ends, add actual employee exit costs. The planned horizon does not eliminate them.
Price the third route and test the result
For a foreign employer, an illustrative alternative uses €1,500 setup, €400 monthly fixed support, €100 per worker monthly and €1,000 administrative deregistration. The €400 includes €200 external support and two internal hours at €100. These assumptions produce €8,500, €24,100 and €88,900 for the same three plans, excluding common employment costs and any additional business-presence obligations.
At twenty employees for 36 months, a foreign-employer quote €40 higher per worker monthly adds €28,800: €88,900 becomes €117,700, above the €116,000 entity illustration. Before changing routes, obtain two itemized engagement letters for the same employees, reporting, benefits work, corrections and exit. Confirm that the difference buys the same work. Separately, €500 more monthly entity overhead adds €6,000, €12,000 or €18,000 to the three plans.
A concrete operating change can override that arithmetic. If the group decides Belgian customers must contract with a Belgian subsidiary that holds the local lease and employs the team, foreign payroll registration alone does not deliver that structure. Obtain the approved contracting/operating plan and a scoped entity-support quote. Conversely, if customer contracts stay with the parent and the only local need is employment, test foreign registration before approving incorporation.
For a verified permissible provider arrangement, compare setup + employee-months × all-in monthly route fee + exit with the entity expression. Unknowns are the eligible provider fee, actual fixed company support, per-worker work, internal hours and exit liability. There is no evidenced market crossover until these are priced on the same scope.
How to move between routes later
Plan the migration before signing the initial arrangement. Moving from foreign employment into an SRL changes the legal employer even when the group and managers stay the same. Ending a provider contract and transferring employment are also separate decisions.
- Establish the employment mechanism. Assess whether the move transfers an economic entity retaining its identity. Where CBA 32bis applies, employment contracts transfer automatically with associated protections and information obligations. An individual payroll migration is not automatically such a transfer.
- Reconcile employment rights. Document service recognition, pay, leave balances, bonuses and benefit continuity. If the move requires agreed new employment rather than an automatic transfer, establish the lawful treatment of the outgoing relationship. Check supplementary pension and insurance arrangements separately.
- Clear permission dependencies. The Flemish portal instructs a new-employer application for ordinary employer-linked permissions, but preserves existing permits for qualifying business transfers and distinguishes Blue Card and seasonal cases. Read it alongside the EU recast rules, which provide a conditional right to change employer and required transposition by 21 May 2026. Obtain written confirmation of the notification/application route and lawful start date for the actual category and transaction. A payroll migration or unchanged group does not itself establish the qualifying-transfer exception.
- Coordinate commercial and payroll dates. Reconcile supplier notice, fees, funding balances, registrations, insurance and payroll inputs. Maintain continuity across the agreed last and first employment dates.
- Close the outgoing infrastructure. Settle records, filings and remaining obligations. Company dissolution and liquidation are separate from stopping payroll; confirm the closure scope before relying on the illustrative allowance.
Decide what to confirm before committing
Collect evidence for the decision, rather than accepting a headline price:
- The actual legal employer, management responsibilities and statutory basis for any supplied-worker arrangement.
- The correct agency approval, assignment reason and permitted duration where relevant.
- The Belgian activity, worksite, worker category, joint committee and employment-document requirements.
- Employer readiness, work permissions, business licenses and a separate tax-presence assessment.
- Comparable quotes separating employment cost, route expense, funding, internal work and exit obligations.
Does one employee make EOR automatically preferable?
No. Establish authority and legal eligibility first. One permanent hire may fit direct foreign employment; one eligible temporary assignment may justify an approved agency. The number alone does not distinguish them.
Does a 12-month hiring plan qualify as temporary agency work?
A budget horizon alone does not establish an authorized reason. The reason, applicable procedure, agency approval and maximum duration must all fit. Permanent work does not become an eligible assignment merely because a service contract expires annually.
Can we use the accounting starting price as the entity budget?
No. Confirm international/group work, employee administration, statutory charges and internal effort separately. Match the engagement letter to the actual operation before replacing the illustrative inputs.
Is the entity's initial funding a setup fee?
Keep initial equity and working funds separate from nonrefundable service charges. The business needs adequate resources; how it spends them creates the relevant expenses. Do not count both the funding principal and the spending as duplicate route costs.
When should we revisit the decision?
Reassess before changing management authority, adding locations, starting regulated or customer-contracting activity, expanding a temporary assignment or changing the employer of a permit holder. Recalculate when headcount, duration or support requirements change.
