Key Takeaways

  • Sector agreements, worker category and the operating establishment's language determine Belgian employment terms; a standard English contract cannot automatically replace the required local-language documents.
  • For Belgian-covered employment, Dimona notification and accident insurance must be in place from the start; payroll declarations, tax remittances and social-security payments are separate obligations.
  • Contract dates and protected status change the dismissal route. For qualifying first fixed-term contracts, notice must finish within the permitted first-half window, capped at six months; paying compensation does not remove protected-worker restrictions.

Employing someone in Belgium requires sector-specific terms, separate registrations and ongoing duties that vary with worker category, workplace and contract dates.

Three decisions deserve attention first: identify the joint committee and document language; separate start declarations, insurance, tax and social-security deadlines; and use the correct start-date rules when ending employment. This guide covers ordinary private-sector employment, with conditional rules identified beside the obligation.

Rules checked 16 October 2026.

Which employment rules apply to your hire?

Belgian legislation supplies the framework, while collective bargaining agreements, or CBAs, often determine the operative wage scale and benefits. Blue-collar and white-collar categories still matter for payroll and leave. Establish these facts before issuing terms. The federal contract guidance explains the layers and contract categories.

Factor What it changes What the employer must establish
Employer activity and joint committee Wage scales, indexation, benefits and sector conditions Applicable committee, CBAs and job classification
Worker category Pay frequency, holiday funding and sickness pay Correct blue-collar or white-collar classification
Operating establishment and language Required employment-document language Establishment to which the worker is attached and applicable language regime
Contract and working pattern Writing, hours and early-exit rules Indefinite or fixed term; full or part time; regular telework
Cross-border circumstances Social-security coverage and tax withholding Actual workplace, residence, employer establishment and any applicable international rules
Headcount and employment dates Representation, consultation and notice Relevant statutory workforce calculation, execution start and service history

Language follows the operating establishment: generally Dutch in the Dutch-language area, French in the French-language area and German in the German-language area. Brussels uses French or Dutch according to the employee's language. An English version can support understanding, but cannot automatically replace the required operative language.

Employer obligations at a glance

Obligation Trigger and deadline Employer action Important exception
Contract and individual information Required contract writing by commencement; individual information by first working day Deliver terms and retain evidence of receipt; see information rules An ordinary indefinite full-time contract can generally be oral; special forms cannot
Social-security start reporting Identify employer first; Dimona IN no later than actual work begins Obtain WIDE identification and worker identifier; retain Dimona acknowledgement Apply Belgian coverage only after the cross-border coverage decision
Accident insurance First worker's first workday Put separate cover in force; retain insurance evidence ONSS registration does not insure the worker
Pay and employee documents Each pay cycle; annual documents separately Apply sector terms, deduct correctly and deliver payslips Category and CBA affect frequency and particulars
Income-tax reporting and payment Monthly or eligible quarterly period; official calendar File FinProf and ensure tax is received by the applicable date Tax-debtor setup and foreign-employer liability need their own assessment
Social declarations and contributions Quarterly; advances where required Submit DmfA and settle employee deductions plus employer liabilities; Q3 2026 deadline is 31 October Filing acceptance does not establish payment
Location-dependent tax treatment Establishment, employee and activity nexus Check regional treatment and distinguish employee income tax from employer levies Do not infer a separate payroll tax or its absence from ONSS registration
Leave and ongoing protection Qualifying absence, annual calendar or workplace risk Track entitlement, payer, benefit declarations and safe return Category, service and CBA can change the answer
Separation Proposed exit, protected status and execution-start cohort Screen procedure before choosing notice or indemnity; use current notice tables Fixed terms, protected workers and collective exits need additional checks

Contracts and the start of employment

Give each document its own deadline

Indefinite and fixed-term contracts are available. An ordinary indefinite full-time agreement can generally be oral, although a written agreement makes the terms easier to administer. Fixed-term and part-time contracts require individual writing by commencement, subject to specific statutory exceptions. Missing fixed-term writing can bring indefinite-contract rules into play. The Employment Contracts Act sets these form requirements.

Separately, supply individual information such as role, workplace, start date, remuneration and working arrangements by the first working day. Electronic information must be accessible, storable and printable, with transmission or receipt evidence retained. Communicate relevant changes by their effective date, except changes to referenced legislation or CBAs.

Covered employers also need work regulations. Give the employee a copy on entry and follow the adoption procedure; file a copy with the competent Social Laws Inspection within eight days of the regulations entering force. That filing period does not defer delivery to the worker. See the work-regulations rules.

Ordinary contractual probation clauses remain invalid, apart from specific regimes such as student and agency work. The new initial notice rule discussed below does not authorize a general probation clause.

Complete start prerequisites separately

For Belgian social-security employment, identify the employer through WIDE, with the enterprise number required for that process. A provisional ONSS number can support Dimona while definitive identification is processed. Obtain the worker's national-register or BIS identifier, using belgianIDpro where necessary. File Dimona by actual commencement.

Arrange withholding-tax debtor identification, the assigned reference, filing access and any representative mandate independently. WIDE is not confirmation that income-tax setup is complete. A foreign employer without a Belgian establishment must establish its withholding position from its actual facts before deciding how salary tax will be collected.

Insurance must cover day one. Even a short uninsured period can trigger compulsory affiliation charges; Fedris can recover compensation paid to an injured worker from the uninsured employer. The separate accident-reporting period creates no insurance grace period.

For regular private-sector telework, obtain a voluntary written agreement by telework commencement. Record frequency, availability, location, support and cost arrangements; supply and maintain necessary equipment and cover work connection costs under the telework regime. Check IP by type of output: the employer normally holds economic rights to employment-created software unless agreed otherwise, while commissioned software needs an express written transfer to the customer. Identify pre-existing code separately. Do not extend the software default to all creative work.

Pay, working time and employment records

Set the sector schedule before running payroll

Apply the binding sector wage scale, classification and indexation mechanism, with the guaranteed minimum income framework where relevant. A national headline amount cannot establish the correct salary for every role.

White-collar staff must ordinarily be paid at least monthly. The ordinary twice-monthly rule for other covered workers allows no more than 16 days between payments. A CBA can set the payment date; work regulations can set it no later than the seventh working day after the period, with the fourth working day as the statutory fallback. Configure the actual pay-frequency rule.

The ordinary framework is eight hours daily and 40 weekly, with reduction to 38 hours effectively or on average. A lawful 40-hour schedule with compensatory days differs from a 38-hour effective week. Lower sector limits and permitted scheduling exceptions matter. Apply the working-time rules before approving overtime.

Where overtime premiums are legally triggered, they are ordinarily 50% on weekdays and Saturdays and 100% on Sundays and public holidays. Preserve compensatory rest where required, normally 11 consecutive hours between work periods, weekly rest and a break when work exceeds six hours. The federal time guidance explains the qualifications. Maintain working schedules, relevant performance/absence records and the individual payroll account.

Follow the money through separate reporting and payment steps

At wage payment, calculate gross remuneration and benefits, employee social deductions and professional income-tax withholding using the applicable employee and pay-period inputs. Give an itemized payslip at each final wage settlement, showing the calculation and deductions.

For taxable salary within the employer's withholding obligation, file through FinProf monthly or, where eligible, quarterly. The 2026 quarterly-regime threshold is EUR 51,480, based on previous-year withholding; confirm the assigned periodicity in FinProf. Ensure the amount due reaches FPS Finance by the corresponding calendar deadline. Keep the accepted return and matched payment evidence separately. Approved social secretariats have a distinct forwarding timetable, so agree which calendar governs each transfer.

A 14 October notice exceptionally extends September and Q3 2026 declarations to 31 October 2026 because of technical problems. Their tax payment deadline remains 15 October 2026. Filing relief does not defer payment.

For example, a direct monthly filer paying October 2026 remuneration must both file and have payment received by 13 November 2026. Quarterly Q4 withholding is due 15 January 2027. These dates come from the official calendar; a generic “15th” reminder would miss the October deadline. Separately, an enacted withholding amendment applies revised parameters to relevant income paid or attributed from 1 November 2026.

ONSS is another cycle. Submit quarterly DmfA wage and performance data; pay employee deductions and employer contributions. The quarterly balance must ordinarily reach ONSS by the last day of the following month: 30 April, 31 July, 31 October or 31 January. Reassess advances each quarter: contributions not exceeding EUR 4,000 in the second preceding quarter ordinarily mean no advances. Missing-comparator employers instead face flat-advance rules, with an exception for a new employer's first two employment months. Required advances use a separate monthly schedule, ordinarily the fifth; apply the advance instructions. Reconcile advances against the quarterly balance.

Employer-only liabilities can include special and sector contributions, blue-collar holiday funding, insurance and sector pensions. Check these separately from employee deductions; an ordinary contribution percentage is not the complete employer liability. The annual blue-collar holiday debit is due 31 March and payable by 30 April. A redistribution debit, where assessed, is due 30 June and payable by 31 July. Reconcile these annual payments separately from quarterly contributions.

Check regional and municipal nexus alongside national payroll setup. Employee regional/municipal income-tax charges and employer business levies are different categories. Review the applicable Flemish, Walloon or Brussels tax rules for the establishment and activity; German-language-area employment also needs the applicable regional/community classification. Do not add a guessed local payroll percentage.

Annually, prepare remuneration fiche 281.10 and its reporting reconciliation. The ordinary authority-filing schedule specifies 28 February following the income year; arrange the employee copy separately. The social-law individual account is another document: provide its identification copy within two months of starting and the completed annual copy before 1 March, under the individual-account rules.

For routine employee data, specify lawful purposes, collect proportionate information, inform workers and control access and retention. The data authority explains the baseline. Monitoring requires additional review: workplace cameras engage proportionality and prior employee-representation information under CBA 68.

Leave, benefits and ongoing employer duties

Record entitlement and payer separately. An employee's right to absence does not establish that the employer pays normal salary throughout.

Right Ordinary entitlement or eligibility Employer administration and payer
Annual holiday Up to four weeks in the current work pattern, principally based on prior-year work and assimilated periods Calculate accrued rights; employer funds white-collar holiday pay and double holiday pay; holiday fund/ONVA generally pays blue-collar workers. Check supplementary rights for starters: annual holiday
Public holidays Ten statutory paid holidays, with replacement days where required Plan paid holidays and display replacement-day notice before 15 December of the preceding year: holiday rules
Sickness Qualifying indefinite or at-least-three-month white-collar contracts: first 30 days' guaranteed salary Employer pays this initial period; health insurance then intervenes. Blue-collar and shorter contracts have different service and payment schedules: sickness rules
Maternity Normally 15 weeks; longer for multiple births Administer leave and protection; mutuality pays qualifying benefits, subject to separate insurance eligibility: maternity leave
Birth leave 20 days within four months of birth for the eligible father/co-parent First three days employer-paid; remaining insured days funded through health insurance: birth leave
Adoption Six weeks per eligible parent, plus four shared weeks under the 2025/2026 stage First three calendar days employer-paid, then mutuality benefit; administer request and supporting documents: adoption leave
Parental Four months' full suspension or equivalent reductions; ordinarily 12 months' service in the preceding 15 and start before the child turns 12 Process the qualifying request and protected return; ONEM generally pays interruption benefit: parental leave

For blue-collar sickness, one month's service ordinarily opens guaranteed pay: employer payment starts at 100% for days one to seven, reduces thereafter, and combines with insured benefits from day 15. Short white-collar contracts use their own schedule. Since 1 January 2026, the ordinary relapse window is eight weeks; a distinct illness or unused entitlement can change the outcome. Do not restart a full guaranteed-pay period automatically.

Check mandatory commuting reimbursement and bicycle allowances under the applicable commuting rules. A supplementary company pension is not universally compulsory, but an applicable sector pension normally requires participation. Establish any sector bonus or allowance before promising a package.

Every employer needs prevention arrangements, including an internal service and external expertise where needed; below 20 workers the employer may act as prevention adviser. Assess workplace and psychosocial risks, prevent discrimination and assess reasonable accommodation, including relevant long-term illness. Plan safe return with occupational-health involvement where applicable.

Report a qualifying workplace accident to the insurer within eight days counted from the day after the accident; serious accidents also require immediate inspectorate notification. Follow the accident-reporting rules separately from insurance coverage.

A prevention committee ordinarily begins at a habitual average of 50 workers; a works council generally at 100, with continuation rules at 50 to 99. Apply the statutory enterprise calculation, organize the required elections and consultation, and check sector union-delegation rules. See the representation framework.

Changing terms and ending employment

Essential terms such as agreed pay or role cannot simply be changed unilaterally. Obtain agreement where required and update the relevant documents. Before any exit, screen protected status, collective-dismissal rules and the contract type.

Use the correct notice cohort

For ordinary employer dismissal, seniority and execution-start date determine notice. Contracts starting from 1 August 2026 have one week's notice below six months' service. Contracts starting from 1 June 2026 have a 52-week cap from 17 years' service; that cap does not apply to every existing worker. Earlier contracts retain their applicable schedules, including legacy calculations for pre-2014 starts. The current FPS tables distinguish these cohorts.

Working notice must state its start and duration. Employers serve it by registered post or bailiff. Registered notice takes effect on the third working day after dispatch, excluding Sundays and public holidays; the notice period begins the Monday following the notification week. Some absences suspend employer notice. Follow the service rules before calculating the end date.

Situation Required process Employer implication
Ordinary indefinite-contract exit Valid working notice or indemnity covering missing notice remuneration and acquired benefits Preserve genuine reasons; paying indemnity does not override protection
Covered dismissal-reasons request Under CBA 109, reply with concrete reasons by registered letter within two months of receiving the valid request Unreasonable dismissal can attract three to 17 weeks' pay; see reasons procedure
Fixed-term early exit without serious cause Post-2013 first contract: notice route only in first half, capped at six months; notice must finish within that window Later exit normally triggers remaining-pay compensation, capped at twice equivalent indefinite-contract notice pay: fixed-term exit
Serious cause Dismiss within three working days after sufficient knowledge; give precise reasons within a separate three-working-day period after dismissal Proof and both clocks matter: serious-cause rules
Protected representative or candidate Prior recognition of permitted grounds by the competent court or joint committee Indemnity cannot replace the protected-worker procedure
Qualifying collective redundancies Information, consultation, authority notification and applicable standstill before individual dismissals Screen the technical operating unit and exits over 60 days: collective procedure

Pregnancy protection runs from employer knowledge until one month after postnatal leave; dismissal grounds must be unrelated to pregnancy or childbirth. Other protected situations have different conditions. Check dismissal protection before using the ordinary route.

Also screen outplacement. The general regime ordinarily applies from 30 weeks' notice or equivalent indemnity: offer within four weeks after working notice starts or 15 days after an immediate indemnity exit, subject to exceptions. See the general outplacement regime. A separate 45-plus regime can apply below that threshold.

Pay outstanding wages without delay, at latest the first payday after termination. Close Dimona OUT by the next working day. Prepare the C4, final pay statement, fiscal fiche and applicable holiday certificate; the current-year individual account has its own deadline within two months after the exit quarter ends. Follow the exit-document rules rather than assigning every document one deadline.

Three situations that change the employer's action

These examples are illustrative, not accounts of actual disputes.

A first worker starts before the quarterly payroll return

Assume Belgian social-security coverage applies. Obtain WIDE identification and the worker identifier, file Dimona by actual commencement, activate accident insurance from the first workday and give work regulations on entry. DmfA follows separately. Combining start reporting and insurance rules means the employer cannot wait for its first quarterly return to regularize the start.

October salary has two different payment calendars

A direct monthly tax filer pays October 2026 salary. Its FinProf declaration and received tax payment are due 13 November. Q4 ONSS contributions follow their separate quarterly balance and any advance schedule. The changed action is to assign separate tax and social-security payment checks, rather than treating a completed payslip or DmfA as proof that both authorities have been paid.

A fixed-term dismissal approaches the halfway point

Assume a first fixed-term contract governed by the post-2013 rules. Before serving notice, identify the execution-start cohort, calculate the applicable notice and allow for service and Monday commencement. The whole notice must end inside the first-half window, capped at six months; suspension does not extend that window. Under the fixed-term rule, serving a letter before the midpoint alone does not preserve the notice route. Assess the compensation consequence if it cannot finish in time.

Managing these obligations through an EOR

A lawful arrangement can assign employment contracts, payroll, benefits and reporting administration to the legal employer. The client still needs to supply accurate work, pay and absence information and respect the agreed allocation of authority.

Belgium generally prohibits hiring out workers where the user exercises employer authority outside a lawful route. A genuine service arrangement's permitted instructions need detailed written limits consistent with actual conduct. Where the user has relevant representatives, it must immediately inform its works-council secretary, or the prescribed prevention-committee/union-delegation contact if no council exists. Supply requested instruction clauses within 14 calendar days, or before a shorter contract ends. Refusing this information can invalidate the service-instruction safeguard: information procedure. Breach can produce presumed indefinite employment with the user and joint payment liability. See the hiring-out restrictions.

Temporary agencies need competent regional/community authorization and a permitted temporary purpose; duration depends on that purpose. A licence alone does not validate indefinite ordinary staffing. The exceptional Article 32 loan concerns permanent staff outside the lender's normal business, for limited duration, ordinarily with prior inspectorate authorization. Narrow group/specialist exceptions instead require user notification at least 24 hours beforehand. Verify the actual permitted route before agreeing client control.

Questions employers ask about employment law in Belgium

Can we use our standard English employment contract?

First establish the operating establishment and required language. Then adapt contract form, sector conditions and individual disclosures. A translation alone does not establish compliance.

Does Belgium allow a probation period?

Ordinary contractual probation remains invalid, with specific exceptions. The one-week initial notice rule for qualifying August 2026 starts is a separate statutory mechanism.

Is submitting payroll enough to satisfy tax obligations?

No. Track employee documents, accepted returns and actual tax and social-contribution receipts separately, including annual duties.

Is every Belgian worker entitled to a thirteenth-month payment?

Determine the applicable sector CBA, company arrangement and contract. Do not assume one universal bonus package. For the broader budget, see our Belgium hiring-cost guide.

Can paying notice compensation resolve any dismissal?

Protected status, discriminatory grounds, collective procedure and fixed-term rules can change the action required. Establish those conditions before calculating notice compensation.
