Key Takeaways

  • Ordinary Lithuanian hires need written terms and Sodra 1-SD notification at least one working day before work. Signing the contract alone does not satisfy advance notification.
  • The employer's tax position can change who pays salary income tax: foreign non-PE salary can follow employee-paid Class B rules. Tax declarations, tax payments and social-insurance remittances retain separate deadlines.
  • Employment changes and dismissal require the applicable consent, lawful grounds and protection checks. Ordinary notice or severance does not override restrictions affecting parents and other protected workers.
  • The enacted November 1, 2026 amendments are future rules on the article's October 16 check date. Transitional provisions can keep earlier rules in place for procedures and probation periods begun before commencement.

Employing someone in Lithuania requires separate decisions about the contract, advance hiring notification, payroll liabilities and the lawful grounds for changing or ending employment. A signed global contract does not complete these duties. The employer's tax status can even change who must pay salary income tax.

The priorities are to keep each deadline attached to its own obligation, preserve family and dismissal protections, and distinguish today's rules from enacted changes starting soon. Rules checked: October 16, 2026.

Which employment rules apply to your hire?

The Lithuanian Labour Code supplies the ordinary private-sector baseline. Applicable legislation, EU rules, collective agreements and special worker protections can change the answer. Establish the employee's habitual workplace and the actual employer before applying a foreign company's standard terms.

Factor What it changes What the employer must establish
Workplace and cross-border status Mandatory employment protection, insurance and immigration requirements Where work is actually performed and which national rules apply
Sector and agreement coverage Pay, working time, leave and consultation The agreement's parties, membership and any valid extension; coverage is not universal
Employee and contract category Probation, leave, scheduling and dismissal protection Age, disability, family status, service and fixed-term or indefinite status
Employer's tax position Salary-tax withholding actor Lithuanian entity, foreign permanent establishment or foreign employer without one

Use the Labour Code and check actual agreement coverage. Lithuania's national baseline should not obscure sector or individual protections.

Major amendments begin on November 1, 2026. They are enacted future rules on this article's check date; transitional provisions preserve earlier rules for specified procedures and probation periods begun before commencement. The VDI reform notice explains that crossing November 1 does not automatically move every existing process onto the new rules.

Employer obligations at a glance

Obligation Trigger and deadline Employer action Important exception
Contract and disclosures Before work starts Sign the written contract and supply the wider employment information Lithuanian language requirements also apply; see the Code
Hiring notification Normally at least one working day before work Submit Sodra 1-SD separately from signing A legal person's sole-member management body has a one-working-hour rule: Sodra hiring
Salary documents At least monthly Give earnings, deductions, payments, hours and overtime information No employee request is needed: payslip duty
Class A income tax Withhold on payment; remit by the applicable same-month date Pay VMI separately from filing GPM313 Foreign non-PE salary can follow employee-paid Class B rules: PIT Act
Tax declarations GPM313 by next month's 15th; GPM312 by following February 15th Submit monthly and annual returns Filing is separate from tax payment
Social insurance SAM and contributions nominally due by next month's 15th Report accrued pay; make the separate remittance Employee deductions and employer liabilities remain distinct: Sodra duties
Leave and safety Throughout employment and on qualifying events Fund employer-paid entitlements, process benefit information and control risks Leave entitlement and Sodra benefit eligibility differ
Separation Ground-specific notice; final pay ordinarily at employment end; 2-SD within one working day after dismissal Document the lawful route, settle and notify Sodra Protected status can prevent the proposed dismissal

Contracts and the start of employment

The contract must identify the job function, remuneration and workplace. Use written form, with a copy for each party. Lithuanian is required; a foreign employee must also receive a language they understand. Electronic documents must preserve the content, sender and delivery evidence and allow saving or printing.

The wider Article 44 disclosure is a separate pre-start duty. It includes the contract type, start and end dates where relevant, probation, pay components and payment rules, hours, leave, exit procedure, applicable agreements, training and social-insurance information. Communicate later changes before they take effect under the contract provisions.

Choose indefinite employment or a lawful fixed term. For the same function, an ordinary fixed term generally cannot exceed two years, except temporary replacement of an absent employee. Successive terms with the same employee for different functions generally cannot exceed five years. Fixed terms for permanent work cannot exceed 20% of the employer's contracts. Special categories and agency contracts have different rules; apply the fixed-term limits before offering the contract.

Agree probation when concluding the contract. Under the October rules, the ordinary maximum is three months, excluding specified absences. A fixed term below six months requires proportionately shorter probation. An unsatisfactory-probation exit requires a decision before expiry and three working days' written notice.

Creative work needs specific terms. For non-software works created within employment duties, economic rights ordinarily pass to the employer for five years, unless agreed otherwise. Employee-created software has a different employer-ownership default. Pre-existing material falls outside that employment-duty trigger. Specify the rights, duration and any licence needed; copyright transfer, licence and commissioned-work agreements ordinarily require writing. See the current statutory reproductions for employee works, software and agreement form.

Complete setup before using the employee notification clock

Confirm employer tax identification, insurer registration and filing authority before setting a workable start date. Foreign legal persons use VMI form FR0227. A foreign company operating through a Lithuanian permanent establishment must register within five working days of activity starting, identified as the first transaction. That PE registration rule is not a universal first-employee filing window.

Then meet the separate advance 1-SD deadline. Where an employee lacks a Lithuanian personal code, arrange Sodra's required identity evidence before notification. Introduce workplace rules, risks and safety instructions before work. Late notification can create illegal-employment exposure; adding the employee to a later payroll does not make an early start lawful.

Pay, working time and employment records

Set the wage and schedule before calculating payroll

The 2026 gross minimum is EUR 1,153 monthly or EUR 7.05 hourly, according to the pay arrangement. The minimum concerns base remuneration; qualified work must be paid above it. Check the wage-floor guidance, work fraction and any agreement before approving pay.

Wages are normally paid at least twice monthly, or once at the employee's request. The ordinary month-end settlement rule is ten working days after the month ends, subject to the Code's qualification for employment contracts or labour rules.

The usual full-time norm is 40 hours weekly. Different limits coexist: average work including overtime is generally capped at 48 hours per seven days, while work including additional-work agreements is capped at 12 hours daily, excluding lunch, and 60 hours per seven days. Provide a lunch break by five hours of work, ordinarily lasting 30 minutes to two hours. Preserve 11 consecutive hours' daily rest and 35 hours' weekly rest, subject to lawful special regimes.

Overtime ordinarily requires written consent. The usual limit is eight hours in seven consecutive calendar days, rising to 12 with written agreement while respecting the average limit; the annual limit is 180 hours unless a collective agreement allows more. Ordinary overtime and ordinary night work attract at least 1.5 times pay, with higher multipliers for specified combinations. Keep actual overtime and other exceptional-time records even where a fixed schedule qualifies for the ordinary time-account exception. These are separate controls under the working-time rules.

Follow the money through separate reporting and payment steps

A Lithuanian entity or foreign employer paying through a Lithuanian PE ordinarily withholds salary PIT as Class A income. Establish the employee's identifier, residence, current rate inputs and any request and eligibility for the monthly tax-exempt amount, NPD. Monthly withholding does not replace employee annual reconciliation. A foreign employer without that PE does not automatically become the withholding actor. Under the 2026 PIT Act, resident employees receiving Class B salary generally declare and pay through their annual return, with a statutory May 1 deadline the following year. A nonresident receiving taxable Lithuanian-work salary from a foreign non-PE company generally files FR0459 and pays within 25 days of receipt. Establish source and treaty treatment first.

For ordinary Class A payments, PIT withheld on payments through the month's 15th is paid by that 15th; tax on later payments is paid by month end. Salary paid in instalments has specific exceptions, including December rules. GPM313 is due by the next month's 15th and annual GPM312 by the following February 15th. Covered employers also have monthly nil-return duties. Use the VMI due rules for the actual payment pattern.

For employment covered by Lithuanian social insurance, calculate employee deductions and employer contributions using the 2026 Sodra tariffs. Employer liabilities include unemployment and occupational-accident contributions and applicable Guarantee and Long-term Employment Benefit funds. Contract type, risk group, exemptions and current pension participation affect the calculation. File SAM for accrued monthly pay by the next month's 15th and separately remit contributions by the nominal same date. An accepted return is not evidence of payment.

Give the monthly payslip, reconcile net pay with deductions and retain bank and authority-account evidence. Provide requested employment and pay statements. For a resident's requested Class A income/tax statement, Article 33 requires free delivery within ten working days of the request. Assess location-related property and municipal fee obligations separately from these national payroll accounts; property taxation has its own nexus.

Pay transparency also requires preparation: approve or update remuneration systems by December 31, 2026. New pay information to Sodra begins January 1, 2027, rather than already being due in October. The VDI transition guidance should inform the implementation timetable.

For routine personnel and payroll data, define purpose and lawful basis, inform employees, restrict access and set justified retention. Before monitoring, assess necessity, proportionality, less intrusive methods and whether a data-protection impact assessment is required; provide the required notice. A contract clause alone does not replace the privacy assessment.

Leave, benefits and ongoing employer duties

Leave administration must distinguish protected time off, employer-paid remuneration and insurance-funded benefits.

Entitlement Ordinary leave or payment basis Employer action
Annual leave At least 20 working days on a five-day week, 24 on six days, or four weeks where weekly days vary or are fewer Pay average remuneration. Under-18s, disabled workers and single parents of a child under 14 or disabled child under 18 have 25 days on five-day weeks, 30 on six days, or five weeks. Holiday pay is normally due by the last working day before leave unless the employee separately requests normal payroll timing
Own sickness Employer pays the first two calendar days coinciding with the schedule, at 62.06% to 100% of average pay Process certified incapacity and employer information; Sodra pays from day three where eligible
Maternity Ordinarily 70 calendar days before birth and 56 after; 70 after complicated or multiple birth Grant leave and supply benefit information; qualifying maternity benefit is paid by Sodra
Paternity 30 calendar days, in at most two parts, before the child's first birthday Grant leave; Sodra benefit ordinarily requires six months' relevant insurance within 24
Adoption Ordinary adoptive maternity/paternity leave is 30 calendar days; current rules ordinarily require granting it within one month of the final decision Check the adoption category and exclusions; adoption parental leave can run 24 months with a separate three-month request window
Childcare Leave can continue until age three; Sodra benefit generally runs to 18 or 24 months Record leave and benefit information separately; each parent has two nontransferable months within the statutory framework

The leave provisions, sickness guidance, paternity conditions and adoption guidance establish different scopes. Ordinary sickness benefit generally requires three insured months within 12 or six within 24; insufficient history does not remove the employer's first-two-day duty. Ordinary maternity and childcare benefits generally require 12 insured months within 24. Adoption has specific exclusions, including spouse-child adoption and prior same-child leave. On return from targeted leave, restore the same or equivalent role on no less favourable terms, including improvements the employee would have received.

Paid family rest is an additional recurring duty. One child under 12 gives one paid day every three months; two children under 12, or a disabled child under 18, ordinarily gives one monthly. Three children under 12, or two under 12 including one with a disability, give two monthly. Apply the family-rest rules and permitted hour-reduction alternatives.

Fund workplace risk assessment, instructions and protective measures for every employee, including remote work. Reimburse additional remote-work costs under agreed amounts and payment conditions. Apply equal recruitment, pay and dismissal criteria, prevent harassment and retaliation, and provide appropriate disability adjustments unless disproportionately burdensome. Above average headcount 50, publish the required equality measures and harassment-prevention policy. At average headcount 20, initiate a works council unless qualifying union membership exceeds one-third. Provide the ordinary annual economic/employment information by April 1 when requested under the applicable council process. Preserve the consultation duties.

Changing terms and ending employment

Specified employer-initiated changes to essential or additional contract terms, working-time regime or locality require written consent. Allow at least five working days to respond. A proposed change and a lawful dismissal are separate decisions under the variation rules.

Situation Required process Employer implication
Employer no-fault dismissal under Article 57 Establish a statutory ground and procedure; ordinary notice is one month, or two weeks below one year's service Ordinary severance is two average monthly wages, or half a month below one year; protections and extended notice can change the route
Protected parent or pregnancy Check the exact ground before issuing notice Raising a child under three restricts specified Article 57 grounds; pregnancy protection has separate duration and exceptions
Genuine fixed-term expiry Above one year's service, give five working days' warning; above three years, ten Above two years, pay one average monthly wage severance; early termination needs another lawful ground
Long service Check eligibility for the separate long-term employment benefit Do not substitute that benefit for ordinary employer severance
Final settlement Ordinarily pay at employment end; permitted agreed settlement must be within ten working days Obtain the required agreement; submit 2-SD separately within one working day after dismissal

The dismissal guide distinguishes grounds and payments. Written notice must state the reason, legal provision and end date; retain delivery evidence. For redundancy, establish the genuine organisational reason, suitable vacancies and lawful selection criteria. The vacancy check runs from notice through five working days before notice ends. A performance route requires written shortcomings and an agreed improvement plan lasting at least two months. Refusal of changed terms alone is insufficient: the proposed change needs the statutory economic, organisational or production necessity.

Screen planned group exits before using individual notice dates. Within a period of up to 30 calendar days, collective rules can apply at 10 exits in establishments averaging 20 to 99 workers, 10% at 100 to 299, or 30 at 300 or more, subject to statutory counting rules. Consult representatives before deciding and notify the Employment Service after consultation, at least 30 days before termination and no later than warning the group. Covered employee representatives separately require VDI consent during office and six months afterward for specified dismissals or adverse changes. VDI has 20 working days from receiving the application to decide; the views process allows at least five working days. Approval does not establish the substantive dismissal's legality. These additional procedures can control the timetable.

Pregnancy protection generally runs from employer knowledge until the baby is four months old, with listed exceptions including genuine fixed-term expiry. Specified no-fault grounds cannot be used against a worker raising a child under three. Where Article 57 dismissal is permitted, notice is doubled below five years to pension age. It is tripled for employees raising a child under 14 or disabled child under 18, pregnant or disabled employees, those with a qualifying serious illness, and those below two years to pension age. Check the protected-worker rules before calculating notice.

For fixed terms, distinguish expiry from an early employer decision. Continuing work beyond one employer-administration working day after expiry can convert the arrangement to indefinite employment. Apply the expiry rules. Longer service can also trigger a separate fund benefit, subject to eligibility and a three-month non-rehire condition.

Settle wages and unused-leave compensation using the current final-pay rules. November's reform introduces different settlement flexibility and changes other exit rules; check the applicable transition before using them.

Three situations that change the employer's action

1. The contract is signed, but the start is tomorrow

Illustration: an ordinary employee is due to start on Monday. Signing on Sunday does not satisfy notification at least one working day before work. Complete employer setup, the contract and disclosures, timely 1-SD, and safety induction in the required sequence; move the start if necessary. A payroll correction after Monday does not cure the advance-notification failure.

2. A parent returns to a reorganised team

Illustration: a worker returns from childcare leave with a two-year-old child, and the employer offers a different job. The return right and dismissal restriction operate together. Restore the same or equivalent role on protected terms; obtain consent where the change requires it. Refusal does not permit dismissal under the prohibited Article 57 grounds. VDI's return-to-work answer identifies a different response, including statutory downtime where contracted work objectively cannot be supplied.

3. Payroll files successfully, but the tax remains unpaid

Illustration: a Lithuanian employer pays the full monthly salary once, at the employee's request, on October 12, 2026. Ordinary Class A PIT must be paid by October 15. The next-month GPM313 filing date does not postpone that payment. Separately account for accrued-pay SAM and contributions. Reconcile the payslip, return acceptance and actual bank remittances using the VMI timing rules.

Managing these obligations through an EOR

An EOR can administer the employment agreement, payroll, statutory deductions and employment processes as the legal employer. The client still needs to supply accurate pay, hours, workplace-risk and personnel-decision information.

Where the arrangement is temporary employment, with the worker under the client user's supervision, confirm the actual employing entity's eligibility and inclusion in the VDI agency list. Permission arises on inclusion. An application pending within VDI's decision period does not authorise supply. User-side induction and equal-treatment duties remain; strike replacement is prohibited under the agency controls.

The three-year limit concerns fixed-term agency employment, including qualifying successive contracts; indefinite agency employment is also permitted. It is not a universal three-year assignment cap. Assignment information ordinarily reaches the worker two working days before start unless they agree to start earlier, with a one-working-day refusal right. Coordinate these agency contract rules separately from 1-SD and confirm the proposed activity and worker's eligibility.

Borderless AI lists EOR among its Lithuania services. The proposed worker and arrangement still need assessment. Using an EOR does not erase client duties, immigration requirements or corporate-tax questions.

Questions employers ask about employment law in Lithuania

Can the employment contract be English only?

The Lithuanian-language requirement still applies. For a foreign employee, also supply a language they understand and retain consistent versions and delivery evidence.

Is three months' probation automatic?

No. Agree it when concluding the contract, apply the current maximum and shorten it proportionately for fixed terms below six months. Check the November transition for later arrangements.

Must hourly-paid staff receive exactly the monthly minimum?

An hourly-paid employee's monthly total can vary with actual hours. Apply the hourly floor to the relevant work; the published monthly and hourly minima are separate measures.

Does childcare leave mean three years of employer-paid salary?

Leave can extend to age three, while qualifying Sodra benefits generally run to 18 or 24 months. Protect the leave and return rights separately from benefit eligibility.

Can paying severance make a dismissal lawful?

The employer still needs a permitted ground, correct procedure and protection checks. Genuine fixed-term expiry, redundancy and protected-parent cases have different requirements.
