Employing someone in New Zealand means administering local minimum rights alongside the employment agreement. Three decisions need particular care: calculating leave from the employee's working pattern, separating payroll filing from actual payment, and checking whether trial or dismissal exceptions apply to this worker.
An overseas agreement or payroll account does not settle those questions. Establish who employs the person, which agreement and immigration conditions apply, and who must account to Inland Revenue before choosing your process.
Rules checked October 16, 2026. All amounts below are New Zealand dollars.
Which employment rules apply to your hire?
New Zealand has national employment minimums. The employee's individual or collective agreement can provide better terms, while worker category, service, work pattern and sector rules affect their application. Start with the employer responsibilities and establish these facts:
Tax scope requires its own assessment. An overseas employer without sufficient New Zealand presence may leave the employee accounting for tax as an IR56 worker. However, fringe benefits and superannuation can create employer FBT or ESCT obligations even without that presence. Use the current cross-border tax guidance, including its amendment notice.
Employer obligations at a glance
There is no separate provincial or city wage-based payroll tax to register for. National deductions, contributions and ACC still apply; local property rates have a different basis. IRD's tax-system review distinguishes payroll taxes from those liabilities.
Contracts and the start of employment
Every employee needs a written employment agreement. Include the parties, work, location, hours, pay and payment method, problem-resolution information and other required provisions. Give the employee a reasonable opportunity to obtain independent advice and consider their response. Keep the intended and current agreement and provide a copy when requested. Minimum rights apply even if the document omits them. Required terms
Permanent and fixed-term employment are different choices. A fixed term requires a genuine work-related reason on reasonable grounds, with the reason and ending mechanism in writing. Testing suitability or the worker's temporary visa is insufficient. Ending a fixed term early requires a good reason and the applicable dismissal process; its expiry date is not an early-exit permission.
Choose a trial only after checking eligibility
An optional trial period can last at most 90 calendar days, begins at the start of employment, and is available only for someone who has never worked for that employer. Agree and sign before any work begins. AEWV workers cannot use it. To use the valid-trial dismissal route, give the required notice during the trial, even if employment ends later.
A probationary period instead needs an agreed, reasonable duration recorded before it starts. It retains ordinary employment rights and requires performance feedback, support and the applicable dismissal process.
Since February 21, 2026, new non-union employees no longer automatically start on collective terms for 30 days. Check actual collective coverage and continue providing required union information. Current changes
Register with Inland Revenue as soon as employment starts. ACC Workplace Cover applies automatically on employing; a later levy invoice does not postpone workplace obligations or work-injury payment exposure.
Pay, working time and employment records
The adult minimum wage is NZ$23.95 an hour from April 1, 2026. Conditional starting-out and training rates are NZ$19.16. Check eligibility before using a reduced rate. The statutory minimum covers employees aged 16 and over; salaries must still cover the applicable minimum for all hours actually worked.
Agreements ordinarily set maximum ordinary hours at no more than 40 weekly, excluding overtime, unless the parties agree otherwise. Overtime compensation follows the agreement rather than a universal premium. An availability requirement needs the applicable guaranteed-hours, genuine-reason and compensation conditions; otherwise an employee can refuse additional work. Extra shifts
An eight-hour work period ordinarily attracts two paid ten-minute rest breaks and one unpaid thirty-minute meal break. Other shift lengths and narrow statutory exceptions differ. Arrange breaks, including reasonable and practicable breastfeeding facilities and breaks. Agree the pay cycle; there is no universal statutory weekly or monthly payday.
Run deductions, reporting and payment as separate duties
For the ordinary New Zealand PAYE employer, collect each employee's IR330 tax declaration, IRD number and tax code. Deduct PAYE, including the employee ACC earners levy, using current instructions; missing required inputs trigger the non-notified rate. Apply student-loan codes and child-support notices where required. Employer's guide
Where IR56 collection applies instead, the employee registers, files within ten working days after month end and pays by the following month's 20th. This differs from the ordinary employer calendar below.
File employment information for each payday. Electronic filing is due within two working days after payday. Permitted paper filing generally allows ten working days, with the applicable payday or half-month reporting option. Electronic filing is ordinarily compulsory at NZ$50,000 or more gross annual PAYE after the first six months, unless an exemption applies. Filing rules
Pay deductions separately. The annual PAYE-plus-ESCT measure determines the ordinary remittance calendar:
Use the September 2026 employer guide for the threshold calculation, prior-tax-year test and connected-employer aggregation. Payment due on a weekend or national holiday moves to the next working day; provincial anniversaries do not extend electronic payment deadlines. Payment timing
For example, an ordinary monthly-remitting employer paying electronically on Friday, October 16, 2026 files by Tuesday, October 20 and pays October deductions by Friday, November 20. Retain the filing receipt and evidence that the payment reached the correct Inland Revenue account and period.
Check membership before setting deductions. KiwiSaver generally requires living or normally living in New Zealand and citizenship or indefinite-residence eligibility; temporary work-visa holders cannot join. Automatically enrol otherwise-qualifying new employees aged 18 to 64 who are not already members, subject to exemptions. Eligible under-18s join through a provider. Give auto-enrolled employees their pack within seven days of starting and submit IR346K before first payday or with the first employment-information return. KiwiSaver employer guide and enrolment steps
Eligible employees' default KiwiSaver deduction and minimum gross employer contribution became 3.5% on April 1, 2026. Eligible contributing members aged 16 and 17 now also attract compulsory employer contributions. Process enrolment, opt-out, suspension and approved temporary-rate notices. Deduct ESCT from taxable employer contributions and remit it with payroll liabilities; set the applicable ESCT rate each April 1. KiwiSaver changes and employer contributions
A nonresident employer without a New Zealand fixed establishment may choose whether to participate in KiwiSaver. Overseas-employer IR56 workers are not entitled to compulsory employer contributions. Check this separately from PAYE collection.
Employee deductions, employer KiwiSaver and ESCT can travel through the EMP payment process but remain separate amounts to reconcile. Employer ACC levies have their own annual invoice and 30-day payment clock. If providing taxable fringe benefits, register for FBT. Ordinary quarterly returns and payment are due July 20, October 20, January 20 and May 31; annual or income-year filing requires the applicable eligibility or election. FBT calendar
A payslip is compulsory when the agreement requires it; accessible pay, time and leave records are compulsory regardless. Keep labour-law records for six years and tax records for seven. Ordinary annual employer PAYE reconciliations and employee tax deduction certificates were removed by legislation; employees can obtain their IRD income summary. That does not replace correcting payroll errors or supplying employment records.
Leave, benefits and ongoing employer duties
Calculate leave from the current working pattern
Employers still apply the Holidays Act. The enacted replacement starts August 6, 2028 and cannot be adopted early. Prepare systems while continuing the current leave rules.
The alternative six-month hours test for sick, bereavement and family-violence leave requires an average of ten hours weekly plus at least one hour every week or 40 hours every month. Holidays Act guidance
Annual holiday pay is the greater of ordinary weekly pay at leave start and average weekly earnings over the preceding 12 months through the last pay period. Pay before leave unless a written normal-cycle arrangement applies. Eight-percent pay-as-you-go holiday pay is restricted to qualifying short fixed terms or genuinely irregular arrangements; a casual label alone is insufficient. Annual holidays and holiday pay
For public holidays, determine whether this employee would otherwise work that day, including the applicable observed day. For sick, bereavement and family-violence leave, use relevant daily pay or average daily pay where permitted.
Separate parental absence, government payments and return rights
Qualifying primary carers, including qualifying adoptive carers of children under six, can take up to 26 weeks after averaging ten hours weekly with the same employer over six months. The 12-month service test can support 52 weeks total, including primary-carer leave. Partner leave is unpaid: one week under the six-month test or two under the 12-month test.
Government parental payments can cover up to 26 weeks under a separate work test, potentially across employers. They are not an employer-funded salary obligation; contractual enhancements are separate.
On an application, request missing information within seven days; the employee then has 14 days to provide it. Respond within 21 days after receiving complete information, and confirm arrangements within 21 days after leave starts. Confirm return arrangements. Employer response
With proper notice, keep the job open for the first parental-leave period of up to four weeks. For longer leave, it must ordinarily remain open unless a key position cannot be temporarily filled or qualifying redundancy applies. A later redundancy requires evidence it arose after the keep-open commitment and that no similar position is available.
Where a key position is permanently filled, or redundancy was known when leave was requested, offer very similar vacancies to the employee first for 26 weeks after leave ends. Redundancy arising later does not automatically create that preference duty. Annual holidays becoming due during parental leave or the following 12 months use a special average-earnings pay rule. Return and preference
Maintain duties beyond the leave balance
For a work injury causing incapacity, the employer pays first-week compensation at 80% of expected earnings, using the first-incapacity date and scheduled earnings. ACC can pay eligible weekly compensation from day eight. Cooperate on medical restrictions and recovery at work. ACC payment guide
Manage physical and psychological work risks, including remote work, and engage workers on safety decisions. Any worker can request an HSR election: initiate it within two months. An HSR or five workers can request a committee, which must be established as soon as practicable. Support representatives' paid participation and training. Representation requirements
Prevent discrimination, address harassment and assess reasonable disability or religious accommodations. Explain employee-data collection and use, secure records, allow access/correction and limit retention. Monitoring needs a lawful basis, clear policy and appropriate consultation. Employee privacy and the privacy principles also cover indirect-collection notices introduced May 1, 2026, subject to exceptions.
Changing terms and ending employment
Agree changes to contractual hours; a flexibility clause still requires fair and reasonable use. For ordinary dismissals, distinguish a justified reason, fair process, required notice and final payments. Paying notice alone does not establish lawfulness.
The workplace-change process requires genuine consultation, without one universal consultation period. Parental protections restrict when a job can cease to be held open. Long-service benefits arise from agreed terms rather than a universal statutory entitlement. Long-service rules
Check the high-income transition before using an exception
Since February 21, 2026, employees meeting the statutory NZ$200,000 annual-remuneration threshold can lose specified unjustified-dismissal and dismissal-related disadvantage protections, unless agreed back in. The calculation includes specified earnings and annualisation rules; it is not simply the salary shown on the offer.
Qualifying employees still in their pre-February 21 job, or a covered restructure role, retain protections for dismissals before February 21, 2027 unless an earlier written agreement applies. Other grievance grounds, notice and remaining good-faith duties survive the exception. Check the current high-income rules before choosing a process.
Use contractual notice or reasonable notice if silent. Where the statutory right applies, an employee may request written dismissal reasons within 60 days of learning of dismissal; provide them within 14 days of the request. Valid-trial and applicable high-income exceptions differ. Written reasons
Pay outstanding wages, annual-holiday amounts and unused alternative holidays; ordinary unused sick leave is not automatically payable. Final holiday pay is due no later than payday for the final pay period. Record the finish date in Inland Revenue information. Final-pay requirements
Three situations that change the employer's action
These examples illustrate decisions, rather than predict dispute outcomes.
A part-time employee works a public holiday. An established employee normally works Mondays and Thursdays and works a Monday public holiday. Their annual entitlement is four working weeks, rather than a universal 20 days. Holiday work also requires at least time-and-a-half and an alternative holiday because Monday was otherwise working. Change the roster and leave/pay calculation together. Holiday test
A manager proposes a 90-day trial for an AEWV worker. Remove the trial from this route: AEWV employment cannot use it. A temporary visa also does not by itself justify a fixed term. Select genuine permanent or properly justified fixed-term employment and apply the relevant performance/dismissal process. Trial eligibility and fixed-term grounds
An existing senior employee is dismissed in October 2026. Assume the remuneration test is met, the employee remains in the same pre-February 21 role, and no early written agreement applies. The transition preserves dismissal protections. A high salary does not permit skipping ordinary justification and fair process for that dismissal. Transition conditions
Managing these obligations through an EOR
An EOR arrangement can place employment agreements, payroll, tax administration and benefits with the employing organisation. The client must still supply accurate hours, leave, compensation and workplace information and involve the employer before changing terms or ending employment.
Where the client controls daily work, New Zealand's triangular-employment framework matters: a contributing controlling third party can be joined to a personal grievance and bear remedies. Workplace responsibilities do not disappear through a service contract.
For AEWV placements, check the appropriate triangular employer accreditation and controlling-third-party safeguards. The direct employer must check client compliance and workplace systems before placement, contact workers fortnightly for the first two months then at least monthly, and increase contact where appropriate. Site visits are ordinarily six-monthly, with less frequent or no visits permitted for low breach risk. Onward placement to another controlling party is prohibited under that route. Confirm the specific worker, role, placement and accreditation before committing to it. Placement requirements
Questions employers ask about employment law in New Zealand
Can an overseas contract replace a New Zealand agreement?
The employment arrangement must satisfy applicable New Zealand minimum rights and written-agreement requirements. Review the actual terms, rather than assume the overseas template is sufficient.
Is everyone entitled to a 90-day probation period?
A statutory trial and probation are different. Trials have strict eligibility and pre-work signature requirements. Probation retains ordinary employment protections, subject to any separate lawful exception.
Does filing payroll mean Inland Revenue has been paid?
No. Check the filed information and the settled payment separately. Electronic payday reporting and monthly or twice-monthly remittance use different clocks.
Can we start using the new leave system now?
No. Continue the Holidays Act rules until the replacement starts August 6, 2028, while preparing systems for the change.
Does an EOR remove the client's employment risk?
It can administer agreed employer functions, but client control, conduct, workplace conditions and immigration eligibility still matter. Confirm responsibilities for the particular arrangement.
Borderless AI's EOR service covers employment-agreement, payroll and benefits administration. Ask our team to assess your proposed New Zealand employment arrangement and the division of responsibilities for your worker and role.
