Employing someone in the Philippines means applying the correct regional wage order, administering several separate payroll obligations, and respecting security of tenure. A foreign contract, probation clause or provider agreement does not remove those duties.
Start with three decisions: which protections cover the worker, when coverage and reporting begin, and what lawful process applies if employment changes or ends. Social-insurance exposure can begin before a reporting deadline. Paying notice does not, by itself, make a dismissal lawful.
Rules checked 16 October 2026.
Which employment rules apply to your hire?
The national Labor Code operates alongside benefit-specific statutes, regional wage orders, social-insurance rules and collective bargaining agreements. This guide covers ordinary private employment; government service, domestic work and maritime employment have separate regimes.
For work in the Bangsamoro Autonomous Region in Muslim Mindanao, BAA No. 82 establishes the Bangsamoro Labor and Employment Code of 2025. Its regional provisions prevail in conflicts and national law applies supplementarily. Check the regional code and Ministry of Labor and Employment requirements before transferring the national payroll, reporting or exit framework below to a BARMM hire.
Coverage is benefit-specific. For example, qualifying managerial employees and field personnel are excluded from certain working-time rules. Working remotely does not automatically make someone field personnel: the exemption concerns work whose actual hours cannot reasonably be determined. Use the Labor Code together with current implementing rules and the relevant benefit statute.

Contracts and the start of employment
Set the employment category and probation standards
Philippine law recognizes written and unwritten employment agreements, but written terms provide evidence of pay, duties, location, hours and benefits. Particular regimes impose writing requirements: domestic-worker contracts must be signed before service in a language both parties understand; covered contracting arrangements require written employee terms by the first day. See the domestic-worker law and contracting rules.
Work necessary or desirable to the usual business ordinarily supports regular employment. Genuine project or seasonal work needs its corresponding scope; a fixed end date alone does not establish an exemption. Ordinary probation cannot exceed six months from starting work. Make reasonable regularization standards known at engagement. Allowing work after probation can produce regular status. Repeated short fixed terms are also vulnerable where they evade security of tenure, as illustrated by the Supreme Court's Sampana decision.
Keep registration and coverage clocks separate
For a locally operating employer, BIR registration is required on or before business commencement, with every applicable tax type registered or updated. Set up compensation withholding when that liability arises. A first-time compensation earner's TIN registration has a separate ten-day employment clock.
DOLE's Rule 1020 guidance states that a new establishment registers within the 30 days before operation. Complete this before operating; the rule is not a 30-day post-hire grace period.
SSS employer coverage begins with operations and employee coverage with employment. Register the employer at the start of operations and report the employee within 30 days of hiring. Employees' Compensation coverage also starts on day one. Under the 2025 SSS circular, first-30-day relief from specified benefit damages depends on the corresponding contribution having been paid before the contingency. Filing later within a reporting window is therefore not a safe insurance strategy.
Register with PhilHealth, obtain the employer and employee identifiers, and report hires within 30 calendar days of starting. Pag-IBIG's registration circular separately requires employer registration before operations, required business and employee data within 30 days of operations, and new-employee registration within 30 days of employment.
Define ownership of work
Under the IP Code, regular assigned duties matter: the employer ordinarily owns duty-created work, while the employee ordinarily owns work outside those duties even if employer resources were used. Commissioned copyright normally remains with the creator unless a written stipulation provides otherwise. Identify background material and obtain an appropriate written assignment or licence; the amended transfer rules distinguish copyright from ownership of a delivered file.
Pay, working time and employment records
Configure wages and hours for the covered worker
There is no single national minimum wage. As of the check date, NCR-28 sets daily rates of PHP755 for non-agriculture and PHP718 for agriculture, service or retail establishments with 15 workers or fewer, and manufacturing establishments with fewer than ten workers, effective 26 September 2026. Other regions require their own order and classification; exemptions require their applicable process.
For workers covered by the ordinary rules, the baseline is an eight-hour day, at least 25% additional pay for ordinary-day overtime, and at least 10% night differential for work between 10 p.m. and 6 a.m. Provide at least 24 consecutive rest hours after six consecutive normal workdays. Rest-day work ordinarily attracts a 30% premium; regular-holiday work ordinarily pays 200%. Holiday coverage and overlapping premiums need their own checks. The general framework does not impose a universal 40-hour week. Pay wages at least every two weeks or twice monthly, with intervals no longer than 16 days. The DOLE handbook explains the coverage exceptions.
Complete the payroll cycle through actual payment
Collect employee TIN and social-agency identifiers, prior-employer Form 2316 where relevant, and the correct tax and contribution inputs. Withhold taxable compensation when paying wages. Identify the statutory payor: the tax law can place withholding responsibility on a person controlling payment for a nonresident foreign employer.
The annual 1604-C instructions do not replace monthly returns or proof of remittance. A successful filing is not proof that the authority received payment. Retain the accepted declaration, bank or agency acknowledgment, and reconciled employee postings.
SSS's regular business schedule effective January 2025 totals 15% of monthly salary credit, split 10% employer and 5% employee, plus employer-funded EC. PhilHealth's 2026 premium is 5% of basic monthly income within the PHP10,000 floor and PHP100,000 ceiling, split equally. Pag-IBIG has a separate employer counterpart that cannot be recovered from staff under RA 9679. Its 2026 electronic-remittance transition requires particular attention when confirming payment schedules.
Taxable fringe benefits for employees other than rank and file can also create a separate employer-paid liability. Classify the benefit and exemptions, register the relevant tax type, and file and pay Form 1603-Q by the last day of the month following the quarter, subject to applicable current adjustments.
Local duties require an additional check. The Local Government Code generally restricts LGU income taxes, but business, professional, community and occupation charges are distinct. For regulated professionals, require proof of professional-tax payment before employment and annually; the ordinary annual deadline is 31 January. Verify the worksite LGU's current revenue rules and any payroll-specific liability separately from national withholding.
Keep records and protect employee data
The payroll rules require individual pay-period, rate, regular and overtime earnings, deductions and actual-payment records, with payment acknowledgment. Keep daily time records subject to the stated category exceptions. Preserve required employment records for at least three years from the last entry. Relevant tax accounting records have a different five-year retention clock, anchored to the return deadline or later filing.
Give employees an itemized pay statement as a payroll control. Pag-IBIG expressly requires its deductions to appear on payslips or corresponding receipts; Form 2316 is a separate tax certificate.
For routine HR and payroll data, disclose legitimate purposes, collect only necessary information, restrict access, secure transfers and apply lawful retention under the Data Privacy Act. Before adding screenshots, tracking or other monitoring, assess necessity and proportionality. The privacy regulator cautions against assuming blanket employee consent resolves surveillance.
Leave, benefits and ongoing employer duties
Separate leave entitlement from its funding
Sources: DOLE leave guidance, SSS sickness, maternity law, paternity law, solo-parent law and adoption law.
SSS sickness requires three contributions in the 12 months before the semester of sickness. For home confinement, the employee generally notifies the employer within five calendar days and the employer notifies SSS within five calendar days of receipt. Hospital confinement has different notification treatment. This is insurance replacement, rather than a universal full-salary sickness entitlement.
Maternity SSS qualification requires three contributions in the 12 months immediately preceding the semester of childbirth, miscarriage or emergency termination. The optional 30-day unpaid extension generally requires written notice at least 45 days before leave ends. Preserve protected employment and return rights, including protection against reductions in rank, status or salary.
Additional rights include two months' paid gynecological-surgery leave after six months' aggregate service in the preceding 12 months, up to ten paid days under the VAWC law, extendible as specified in a protection order, and paid lactation intervals totaling at least 40 minutes per eight-hour work period.
Covered rank-and-file employees who worked at least one month receive 13th-month pay of at least one-twelfth of calendar-year basic salary earned, by 24 December. The DOLE compliance report is due by 15 January. Hotels, restaurants and similar establishments also distribute collected service charges fully among covered non-managerial workers.
Maintain safety, fair treatment and worker representation
Provide a safe workplace, risk controls, appropriate free protective equipment and worker safety instruction under RA 11058. The revised safety rules cover alternative workplaces and sector-specific staffing. Determine headcount and risk before assigning safety personnel: BPO establishments with one to nine workers require one SO1, while those with ten to 99 require one SO2. Orientation is employer-funded and compensable.
Maintain anti-discrimination procedures and reasonable disability accommodation. The Safe Spaces Act requires prevention measures, a workplace policy and an independent complaint mechanism, with a woman chair and at least half women on the investigating committee. The committee must investigate and decide complaints within ten days or less. Protect confidentiality and against retaliation. Respect workers' organizing rights and bargain with the recognized representative; applicable collective agreements can improve the statutory baseline.
Changing terms and ending employment
Review contractual and established benefits before reducing them. A new management memo does not erase the non-diminution rule.
For authorized-cause calculations, a service fraction of at least six months generally counts as a year. Closure and serious-loss exceptions require their own evidence. Notice payment cannot replace lawful cause. Maternity use cannot justify demotion or dismissal.
Retirement is distinct from SSS pension. Absent a governing plan, the ordinary statutory route is optional from 60 and compulsory at 65 after at least five years, with a minimum benefit whose half-month definition includes statutory additions. The retirement law exempts specified retail, service and agricultural establishments with no more than ten workers.
Under final-pay guidance, release final pay within 30 days after separation, subject to a more favorable agreement or policy, and issue a certificate of employment within three days of request. Keep those clocks separate. Reconcile lawful deductions and clearance issues without assuming clearance automatically restarts the deadline.
Three situations that change the employer's action
1. The new employee is injured before the first payroll
Illustratively, an employee starts on Monday, 19 October 2026 and suffers a work-related injury on Wednesday, 21 October. SSS and EC coverage already began. The employer must handle the incident and reporting, rather than wait for payroll. The EC program requires a log entry within five days of knowledge or notice and reporting to SSS within five days after entry. The separate SSS damages condition makes payment before a contingency consequential even inside the hiring-report window.
2. A remote hire approaches six months without disclosed standards
Remote work does not automatically remove working-time protections, and a probation label does not preserve probation if qualification standards were never disclosed. Check both actual time-control facts and engagement documents. The changed action is to assess regular status and use the applicable lawful exit process, rather than issue an assumed probation-expiry notice.
3. A foreign client wants to remove an EOR employee immediately
A client ending an assignment does not itself establish lawful redundancy or misconduct. The legal employer needs the actual facts, relevant evidence, required procedure and any separation payment. The parties must also examine who controls work methods. Registration and a commercial instruction cannot cure an unlawful labor-supply structure.
Managing these obligations through an EOR
An EOR arrangement can administer employment contracts, payroll, benefits and statutory reporting. In the Philippines, its legal structure requires a factual check. DO 174 regulates covered trilateral contracting, requires contractor registration and prohibits labor-only contracting. Covered contractors must have an independent business, at least PHP5 million in substantial capital and the applicable investment, and control over work methods apart from the principal's direction on results. The certificate lasts two years unless cancelled; the contractor applies for renewal 30 days before expiry. Principal liability can remain, and unlawful arrangements can make the principal the employer.
The DOLE clarification excludes genuine IT-enabled process outsourcing and certain personally performed professional services from that order. An IT job title does not establish the exclusion. The Supreme Court's control analysis examines actual methods and supervision. Confirm the applicable route, registration and any sector rules before engagement; do not assume one universal EOR assignment limit.
Agree who supplies hours, leave, benefits, performance evidence and exit instructions, and who proves declarations and payments completed. EOR employment does not automatically resolve immigration permission, regulated activities or corporate-tax presence.
Questions employers ask about employment law in the Philippines
Is probationary employment at will?
No. Disclosed qualification standards, the ordinary six-month limit and the applicable termination procedure matter. Review the evidence before deciding the employee's status.
Must every employee receive separate vacation and sick leave?
The ordinary statutory mechanism is five-day service incentive leave after one year, subject to exclusions. Contractual leave and qualified SSS sickness benefits are separate checks.
Does filing a payroll return finish the employer's tax duty?
No. Reconcile the declaration with actual remittance and employee documents. SSS, PhilHealth and Pag-IBIG also have separate reporting and payment obligations.
Can the employer dismiss someone by paying one month's notice?
Payment does not establish lawful cause or replace procedure. Authorized business causes also require notice to DOLE and cause-specific evidence and payments.
What should we confirm before using an EOR?
Confirm the legal employer, actual control, applicable contracting rules, worker eligibility and responsibility for payroll, records and exits. Borderless AI's EOR service supports contracts, payroll and benefits administration. Discuss the role, location and proposed arrangement with us to confirm support and responsibilities for the specific hire.
