Key Takeaways

  • Collective-agreement coverage and actual duties determine Danish employment terms. For covered salaried employees, the special 14-day probation dismissal route requires agreed probation of at most three months; the broader six-month ceiling does not extend it.
  • Insurance, employment information, withholding registration and payroll payments run from different triggers. A tax-registration window does not allow covered work to begin uninsured, and an accepted payroll declaration does not prove payment.
  • Notice payment does not cure an unlawful dismissal. Family-leave protections, reasonable-justification requirements and collective consultation or waiting periods can change whether and when employment may end.

Employing someone in Denmark starts with two decisions: which collective agreement binds the employer, and whether the employee's actual duties bring them within the Salaried Employees Act. Those answers change pay, pension, probation and dismissal obligations. Then assign separate owners for insurance, employment information, payroll reporting and payments. Their deadlines do not run from the same event.

Rules checked 16 October 2026. This guide covers ordinary private employment in Denmark, excluding Greenland and the Faroe Islands. Sector, posting and cross-border social-security rules can change the result.

Which employment rules apply to your hire?

Danish legislation supplies important protections, while collective agreements determine many everyday terms. Establish coverage before using a global contract template.

Factor What it changes What the employer must establish
Collective agreement Pay scales, pensions, hours, overtime, leave pay and procedures Whether the employer is bound, which employees it covers and the current text
Actual job category Salaried-employee sickness, probation and exit rights Duties, employer direction and average weekly hours; monthly pay alone does not establish status
Contract duration and work pattern Fixed-term renewal, probation and predictable-work protections Genuine end event, guaranteed hours and any renewal reason
Work location and sector Workplace safety, posting rules and special sector laws Where work occurs and whether a special regime applies
Foreign-employer tax nexus Who must withhold Danish salary tax Danish establishment, liable payer and any special cross-border arrangement
Social-security coverage ATP and other contribution obligations Whether Danish coverage applies or a valid cross-border exception does

The Salaried Employees Act covers specified office, sales, technical, clinical and supervisory work under employer direction, averaging more than eight hours weekly. Its threshold differs from the employment-information law's threshold.

A foreign employer's withholding position also needs its own check. Danish employee tax liability does not by itself establish the foreign company's withholding duty; establishment, payer and labour-hire rules matter under the Withholding Tax Act.

Employer obligations at a glance

Obligation Trigger and deadline Employer action Important exception
Establish applicable terms Before setting the offer Identify agreement and statutory category Agreement coverage differs by employer and role
Protect against work injuries From covered work Maintain accident insurance; arrange occupational-disease coverage through AES Tax-registration windows do not postpone insurance duties
Give employment information Core particulars within seven calendar days after start; remainder within one month Deliver accessible written information and retain proof Qualifying agreements can implement equivalent protections
Register withholding status Within eight days after withholding liability arises Obtain employer registration and reporting access A CVR number alone does not complete every registration
Complete salary payroll Each payment, then monthly deadlines Withhold, issue statement, declare and separately pay Employer classification changes the tax calendar
Pay mandatory contributions Pay-period reporting and quarterly collection Report ATP; check and settle Samlet Betaling liabilities Each scheme has its own scope
Check additional payroll tax Specified activities and taxable-base threshold Register, file and pay national lønsumsafgift if applicable Municipal employee tax uses national withholding; property taxes are separate
Record time and manage rest During covered employment Keep daily records and enforce hours/rest limits Narrow statutory and agreement exceptions require checking
Administer leave Accrual, absence and reporting events Separate absence, wages, benefits and reimbursement Benefit eligibility does not define total leave
Change terms or dismiss Before communicating a decision Check reason, notice, protection and consultation; settle balances Notice pay cannot cure an unlawful dismissal

Contracts and the start of employment

The 2023 information law generally covers employment averaging more than three hours weekly over four consecutive weeks, plus arrangements without guaranteed paid work. Core information includes identities, workplace, role, start, duration, probation, pay and working-time arrangements. Other listed particulars include paid absence, notice, training, agreements and social protection. Use the split deadlines above; electronic delivery must permit access, storage and printing, with evidence of delivery.

Indefinite and fixed-term employment are possible. Successive fixed-term renewals need objective grounds. State the end condition and check whether early termination is permitted.

The general probation ceiling is six months; fixed-term probation ordinarily cannot exceed one quarter of the term or six months, and renewal cannot restart it. Preserved salaried-employee rules allow the special 14-day employer-notice route only for agreed probation lasting at most three months. Check the applicable agreement before choosing terms. Use language the employee understands; the information statute requires writing rather than establishing a universal Danish-only contract.

For a withholding employer, registration is due within eight days after liability arises. Obtain CVR/SE details, reporting authority and employee identifiers before the first eIndkomst submission. Arrange accident insurance covering the first workday; an uninsured employer can face equivalent premiums and reimbursement of compensation expenditure.

For technology roles, specify IP rights. Qualifying employee software transfers by statutory default; pre-existing code and commissioned materials need appropriate licence or assignment terms. For qualifying employee inventions, the employer's statutory acquisition notice is due within four months after employee disclosure, with remuneration rights separately assessed.

Pay, working time and employment records

Agree ordinary pay, then enforce statutory time protections

Denmark has no universal statutory minimum wage. Pay dates, ordinary hours and overtime remuneration come from the applicable agreement and contract. A common 37-hour week is a negotiated standard, not the statutory maximum. Specify the payment frequency and overtime treatment in the written terms. See labour rights.

For covered adult employees, working time including overtime ordinarily averages at most 48 hours weekly over four months; daily work exceeding six hours requires a break. Use an objective, reliable and accessible daily recording system, give employees access to their entries and retain records for five years after the averaging period ends. Remote work does not itself remove the duty. Specific autonomous roles, sectors and qualifying agreements need separate analysis.

Ordinary rest is 11 consecutive hours in each 24 hours, plus a weekly rest day adjoining daily rest, subject to lawful exceptions under the Working Environment Act.

Complete the payroll cycle, including payment

For ordinary Danish withholding payroll, obtain the employee's CPR and correct electronic tax card. Request additional required identification for employees resident abroad. Withhold A-tax using the card and ordinarily 8% employee AM contribution. From 2026, AM exemption lasts through the calendar year the worker turns 17. Without a valid tax card, the fallback is 55% A-tax without allowances, plus applicable AM.

Payroll duty Ordinary employer action and timing
Employee statement At payment or credit, give written income, period, deductions and employer identification; use secure accessible electronic delivery where applicable. Retain supporting records five years after financial year-end under the tax order.
eIndkomst declaration Ordinary small/medium employers report monthly by the 10th of the following month, or 17 January for the December period. Weekend/holiday deadlines move to the following weekday. Large employers report by the income month's last bank day. Reporting rules.
A-tax and AM remittance Separately pay the withheld amounts to the Tax Account by the applicable 10th/17 January deadline, moved to the next bank day if bank-closed; large employers use the income month's last bank day. Retain payment evidence and reconcile the account. Payment rules.
ATP and employer schemes Deduct the employee's one-third ATP share and fund the employer's two-thirds where covered. Report through payroll; quarterly Samlet Betaling collects ATP and applicable employer schemes, including AES, AUB and maternity equalisation. ATP guidance.
Holiday money For allowance-paid workers using FerieKonto, report and pay by month-end when the pay period ends on days 1 to 15, or by the following month's 15th when it ends later. Follow the official bank-day adjustments. Departing salary-paid staff have a separate exit deadline. Holiday calendar.

Use the employer classification on the registration certificate. The large-employer test considers annual A-tax exceeding DKK 1 million or AM exceeding DKK 250,000 in the statutory reference period. A successful declaration is not proof that money was paid.

For Samlet Betaling, quarterly ATP reporting cutoffs are 31 May, 31 August, 30 November and 28 February. Contributions for those quarters are payable on 1 July, 1 October, 1 January and 1 April respectively, moving to the following weekday after weekends or holidays. Keep ordinary monthly payroll reports timely; scheme exclusions and annual apprenticeship assessments need separate attention.

Employee municipal income tax is collected within national A-tax. The official municipal tax categories support treating ordinary private payroll as having no separate general municipal employer payroll levy; property and activity charges remain distinct.

National lønsumsafgift can apply to specified activities, including some VAT-exempt services, when its taxable base exceeds DKK 80,000 over twelve months. If applicable, register at least eight days before starting taxable activity, or when exceeding the threshold becomes clear. Methods 1 and 3 are quarterly, method 2 monthly, and method 4 employers have quarterly instalments plus annual settlement. Filing and payment generally fall on the following month's 15th for monthly/quarterly periods. For method 4 annual settlement, companies other than personally owned businesses file and pay by the 15th of the eighth month after the fiscal-year-end month. Personally owned businesses, including partnerships, use 15 August, deferred to the following year if the next 15 August is less than five months after year-end. Pay the annual difference after quarterly instalments; weekends/holidays move payment to the next weekday. For calendar-year 2025, the official deadline was 17 August 2026.

Ordinary salary uses monthly reports, payment statements and corrections rather than a separate universal annual employer salary certificate. Reconcile year-end records; specific pension reporting can have annual duties.

For routine employee data, document the lawful basis, explain collection and sharing, restrict access, secure records and set justified retention periods. Assess purpose and proportionality before monitoring, and give required prior information. The Data Protection Agency provides employment guidance.

Leave, benefits and ongoing employer duties

Separate absence rights from who pays

Ordinary entitlement Employer payment and administration
Annual holiday Five weeks, normally 25 working days; paid entitlement accrues at 2.08 days per employed month. Monthly-or-longer paid staff entitled to full pay on sick days and public holidays normally receive salary plus a 1% supplement; others normally receive 12.5% holiday allowance. Discuss dates, then ordinarily give three months' notice for main holiday and one month for other holiday. Holiday Act.
Sickness Covered salaried employees ordinarily retain salary. Where full wages are not owed, employer sickness benefit normally covers the first 30 calendar days if the worker meets eight continuous weeks and 74 hours with that employer, subject to statutory alternatives. Municipal benefits have separate eligibility. Sickness guidance.
Birth and parental absence Mother: four weeks before expected birth and ten after, with the first two compulsory. Father/co-mother: two weeks within the first ten weeks after birth. Each parent then has 32 weeks' parental absence, with extension rights. These are absence rights under the Maternity Act, not a promise of salary for every week.
Family benefit and adoption Eligible cohabiting parents ordinarily have 24 benefit weeks each after birth; employee allocation includes nine non-transferable parental weeks in addition to two birth-related weeks. Adoptive parents ordinarily each have six weeks' absence in the first ten after receipt, then parental absence; benefit allocation is separately assessed. Benefit conditions, adoption rules.

Holiday accrual runs September to August, with taking allowed through the following December. Pay the 1% supplement at the relevant holiday's start or through the permitted May/August payments. Separately, fixed-pay employees whose hours increase under the Great Prayer Day legislation accrue a 0.45% wage supplement, paid with May/August wages or continuously. Do not merge those supplements.

Family benefits ordinarily require employment at leave start and 160 hours in the preceding four complete months, including 40 hours in three. Salary during leave follows statutory category, agreement and contract: salaried women have a half-salary maternity floor from maternity-leave commencement through 14 weeks after birth. Other terms can improve payment and pension rights.

Report family leave through NemRefusion even without salary. For salary reimbursement, the ordinary application deadline is eight weeks after the last paid leave day. Report unpaid leave promptly: the employee normally has eight weeks from first absence to apply for benefits. Preserve return rights to the same or equivalent role on no less favourable terms after protected leave.

Sickness reporting also depends on payment: a salary payer reports within five weeks of first absence when it extends beyond the employer period; a sickness-benefit payer within one week after its benefit payment ends; an employer paying neither within fourteen days of first absence. Hold the ordinary sickness follow-up interview no later than four weeks after first absence, subject to statutory exceptions, and assess return-to-work adjustments. Since July 2026, where recovery is expected within 26 weeks, municipal retention assistance ordinarily needs an employer or employee request; assess whether help is needed.

ATP generally applies from age 16 with at least nine weekly, eighteen fortnightly or thirty-nine monthly hours, subject to coverage exceptions. Occupational pensions beyond ATP, extra holiday and allowances depend on the applicable agreement or contract. Enrol and remit under those terms rather than importing a universal pension percentage.

Maintain a safe, fair workplace as the workforce grows

Carry out an APV workplace risk assessment covering physical and psychological risks, involve employees and implement a written action plan. Reassess relevant work changes and review workplace conditions at least every three years. Ordinary safety cooperation uses direct dialogue for 1 to 9 employees, an organisation for 10 to 34, and two levels from 35; sector exceptions apply. See the current safety law. Since 1 July 2026, submit a work-accident report within fourteen days after the first absence day where the injury prevents usual work for at least three days beyond the accident day. Modified duties can count. Where the absence threshold is not met but compensation or other statutory benefits are expected, report within fourteen days after the accident. Finish submission in EASY; a saved draft is insufficient.

Prevent discrimination and harassment, ensure equal pay for equal work or work of equal value, and make appropriate disability adjustments unless disproportionate. Qualifying Danish companies averaging at least 35 employees over three years must recognise the employee right to initiate board representation; election procedures apply.

Existing equal-pay rules also trigger annual gender pay statistics for qualifying groups at employers with at least 35 employees and ten of each sex in the same job function, subject to statutory alternatives. Review statistics received by 1 September; where the statutory self-preparation conditions apply, prepare them by 31 December for employee information and consultation. The new pay-transparency bill remains introduced legislation as of this guide's check date, with a planned March 2027 start. Do not treat the proposal as replacing present duties.

Changing terms and ending employment

Material changes to pay, duties, hours or location ordinarily require agreement or the applicable termination-notice process. At 35 employees, establish timely representative information and consultation on significant employment matters unless an equivalent agreement supplies the process. This is separate from individual notice; the consultation statute does not impose one fixed day count for every consultation. Written information about changed particulars is separately due by their effective date. A new addendum alone does not authorise an immediate detrimental change.

Situation Required process Employer implication
Ordinary salaried dismissal Written notice; ordinarily one month during the first six months, then three months, rising with service to six, generally ending at month-end Calculate service and departure timing; give reasons in writing on request
Service of at least one year Check reasonable justification under salaried rules and any agreement protection Notice and substantive fairness are separate
Long service Employer-dismissed salaried staff receive one month's severance at 12 years or three at 17 Settle at departure in addition to applicable notice
Fixed term ending early Check contractual terminability, statutory notice and damages exposure A future expiry date does not permit immediate cancellation
Pregnancy, family leave or disability Apply protection, required reasons and accommodation assessment During protected pregnancy/leave periods, the employer must prove an unrelated dismissal reason
Representative or collective redundancy Check special protection and consultation/notification before final decisions Ordinary individual notice may be insufficient

The salaried rules, family protections and discrimination law govern different checks. Unlawful dismissal can produce compensation or reinstatement exposure despite notice payment.

Screen contemplated redundancies within 30 days: at least ten in establishments normally employing 21 to 99, 10% at 100 to 299, or thirty at 300 or more trigger collective procedures. Dismissals normally cannot take effect until 30 days after statutory notification. For reductions of at least 50% at a workplace normally employing at least 100, an eight-week waiting period applies, subject to the statutory agreement exception; the special notification normally follows at least 21 days of negotiations.

Safety representatives also have agreement-based representative protection or, where that does not apply, six additional weeks of notice. At departure, settle earned wages, applicable bonus, supplements, severance and holiday under the governing terms. For salary-during-holiday staff leaving employment, report unused holiday money by the last bank day of the departure month; where FerieKonto or a holiday fund collects it, pay by that deadline too. Issue final pay records and required dismissal explanations.

Three situations that change the employer's action

These examples are illustrative, not case outcomes.

A first employee starts before the first payday

Assume covered work starts 2 November 2026 and first salary is paid 30 November. Insurance must cover work from 2 November. Employment-information clocks run from the start; withholding registration runs from liability arising, not from the start date. If that liability first arises at the November payment, its eight-day window ends 8 December. Arrange registration operationally before payroll; do not use that window to leave November work uninsured. This combines the insurance and registration rules.

An office hire receives a six-month probation template

First test statutory salaried status. If covered, the salaried probation rule permits the special 14-day dismissal route only for agreed probation of at most three months, with employment ending within it. The broader information law's six-month ceiling does not extend that route. Change the template and calculate the notice backwards from probation expiry.

A parent asks for leave beyond benefit-funded weeks

Check statutory absence before rejecting the request because the usual 24 benefit weeks are exhausted. Then determine salary entitlement under category and agreement, report the absence and preserve return rights. The absence statute and benefit rules answer different questions.

Managing these obligations through an EOR

An EOR arrangement can administer employment agreements, payroll, deductions and leave records, with responsibilities allocated in the service agreement. The client still needs to supply accurate hours, workplace risks, proposed changes and performance facts.

Where the arrangement is temporary agency work under client direction, agency legislation requires equivalent basic conditions and objective justification for successive assignments, subject to qualifying agreement alternatives. Confirm the arrangement's legal category, sector and worker eligibility before relying on it; an EOR label does not establish unrestricted assignment duration or immigration permission.

A foreign temporary service provider may separately need RUT registration by work commencement, with changes reported by the next working day. This is conditional posting registration, not a requirement for every domestic hire.

Questions employers ask about employment law in Denmark

Is every monthly paid employee a statutory salaried employee?

No. Actual duties, subordination and the statutory hours test determine coverage. Apply the category before selecting probation, sickness and notice terms.

Does Denmark require a national minimum salary?

There is no universal statutory minimum wage. Identify binding collective-agreement pay requirements and agree clear remuneration. Special sectors or immigration routes need their own checks.

Does filing payroll pay the tax automatically?

No. Accepted eIndkomst reporting and tax remittance are separate completion checks. Verify the payment arrangement and reconcile the Tax Account; ATP and other scheme invoices have separate calendars.

Can an employer dismiss someone on parental leave by paying notice?

Notice payment does not remove pregnancy or family-leave protection. Establish an independent lawful reason, meet the applicable burden of proof and provide the required explanation.
