Key Takeaways

  • Agree the replacement package and confirmed start before supplier exit; an EOR proposal must satisfy Belgium's restrictions on supplying workers and employer authority.
  • A genuine contractor with no prior employee holiday rights may need separately agreed paid absence immediately after conversion; the 2 November example cannot complete the supplementary-leave qualifying period during 2026.
  • Employment start, first actual work, supplier payment and later payroll filings can have different dates; assign each duty and retain separate completion evidence.

To convert an existing contractor in Belgium, agree the employee package and obtain a confirmed start from the prospective legal employer. Coordinate readiness with the actual supplier agreement's end, then verify wages and scheduled filings/payments. If considering an EOR, settle its lawful arrangement and handoff responsibilities before ending supplier service.

Three Belgian details can change that plan: paid holidays depend on employee history, the contractual start can differ from the first working day, and an EOR arrangement must satisfy Belgium's restrictions on supplying workers to another business.

Rules checked 19 October 2026. The worked example assumes direct employment in the City of Brussels; regional work-permission rules and sector agreements need their own checks.

What changes when a contractor becomes an employee in Belgium?

Record the changed relationship before comparing monthly amounts.

Establish status, work rights and the employment route

Belgian status criteria examine intention, freedom to organise working time/work, and possible hierarchical control. Check actual conduct: where it suggests existing employment, assess the earlier period and associated rights separately before treating the proposed date as a fresh beginning.

Choose the legal employer. The example uses a Belgian entity; social-security reporting also accommodates a foreign employer without a Belgian establishment. That category does not settle corporate-tax presence or every registration obligation.

For an EOR, establish who exercises employer authority. Belgium generally prohibits employee lending where the user exercises that authority. Permitted written instructions must preserve the employing party's authority. If the arrangement uses temporary agency work, it needs regional approval, a permitted temporary-work reason and the relevant duration limits. Obtain its legal structure and allocation of instructions before selection; do not assume unrestricted permanent placement.

Verify permission for the employee job: a professional card for independent activity does not establish salaried-work permission. In Brussels, applicable employment authorisation must precede work; longer-than-90-day employment ordinarily uses the single-permit route unless an exemption applies. Flanders and Wallonia administer their own regional regimes. The Belgian citizen in our example does not activate that permit process.

Agree the offer, start date and treatment of existing rights

Agree the following terms with the worker and prospective employer before ending supplier service. Belgian employment information about the individual relationship is due by the first working day; preparing it earlier makes the handoff reviewable.

Service and early terminationDefine any recognition of earlier service by purposeGenuine contractor tenure is not automatically employee seniorityActual history, recognition clause and applicable rules
IP and confidentialitySeparate future duties from earlier deliverablesDifferent IP regimes apply; confidentiality terms should match the workRights inventory and written clauses

The employer's activity principally determines the joint committee. An office job alone does not establish JC200, a universal thirteenth month or indexation formula. State the actual schedule under the general 38-hour framework, effectively or on average, with exceptions/collective arrangements. Apply sickness-pay rules for the contract and worker category.

Obtain a start-ready handoff

Agree who supplies and accepts each handoff item:

  • Your business and procurement/legal owner: provide the actual contractor agreement, supplier identity, notice or consent terms, last-service and invoice details, role/schedule, proposed service recognition and existing IP records.
  • The worker: accept the package and supply identity, employee work-rights evidence, prior employee/holiday records and the personal payroll inputs requested by the employer.
  • The prospective legal employer, including an EOR where lawful: confirm accepted terms, collective classification, service/IP treatment, work permission, coverage and benefit dates, payroll inputs, admission responsibilities and the start date in writing.

Confirm this allocation in your agreement and obtain accepted start readiness before releasing the supplier. Assign later declarations/payments to named owners; these follow after employment begins.

Bridge the leave gap explicitly

Ordinary annual holiday rights generally derive from employee work or assimilated periods in the preceding calendar year, up to four weeks under the current work pattern. For qualifying white-collar leave, normal pay continues and additional double holiday pay is calculated from qualifying history.

Supplementary holidays have qualifying conditions, including three months of activity, and their pay is an advance against later double holiday pay. ONVA guidance expressly addresses self-employed people becoming employees and the qualifying period within the same calendar year. A first employee start on 2 November cannot complete 90 days during 2026. Discuss separately agreed paid absence if the offer needs a usable leave allowance immediately.

Ordinary trial clauses remain invalid for this contract category. A separate 2026 law, effective 1 August, provides one week's notice on either side below six months' seniority for the new contract-start cohort. Dismissal protections and formalities still apply. Define contractual service recognition precisely.

Compare the old invoice with the employee package

This hypothetical bridge compares €5,000 monthly revenue excluding VAT and €300 contractor expenses with proposed €4,000 gross wages. No universal conversion ratio or equal take-home income is implied.

The contribution overview gives 13.07% employee contributions and a 25% private-profit employer orientation. The employer figure is a rounded illustration; actual category rates, reductions and special contributions require payroll calculation. Salary plus ordinary employer share is €5,000 before other costs. Resolve leave, benefits, expenses and actual net pay before accepting the package. For the recurring budget, use the Belgium cost guide.

Complete the country conversion steps

  1. Your legal/procurement owner clears the existing engagement. Review actual status, supplier identity and contractual exit terms. Agree an end date conditional on the accepted employment handoff.
  2. The employer and worker accept the package. Complete the rights decisions above, confirm work permission and obtain written start readiness. Your business reconciles the final-service and first-pay dates.
  3. Employer payroll checks registration. A first employer uses WIDE: secure identification supplies a provisional ONSS number for admission, followed by definitive number/category notification. An existing employer confirms its own registration and filing category.
  4. Employer HR completes entry protection and rules. Put accident insurance in place from entry; organise prevention and any risk-based assessment before assignment. Under the work-rules procedure, no-council adoption involves 15 days for observations, effect on the fifteenth day after display absent observations, and submission of the draft/register. Objections can change the start. Supply rules on entry and deposit a copy within eight days of effect.
  5. Employer payroll admits this worker. Dimona IN is due by actual first performance, recording the contractual start. Validate NISS, residence/family inputs, taxable pay/benefits, deductions, bank details and mandates; close local applicability separately.
  6. Payroll and treasury deliver first pay. Reconcile wages and deductions, transfer net pay and deliver the payslip at settlement. Establish the individual account; deliver its identification copy within two months, early with first pay here.
  7. The agreed owners complete later obligations. Reconcile accepted declarations with separate payment receipts. Annual account entries are due by the Q4 ONSS declaration deadline; employee-copy delivery is a separate later duty.

A worked Brussels cutover

This direct-SRL illustration keeps the City of Brussels registered office and sole workplace, showing first-employer admission and later payroll. A prospective EOR must confirm its own registrations, category and allocation before adapting it.

Assume a first ONSS employee who is Belgian, resident, ordinary white-collar, Monday to Friday, with no prior employee holiday rights. The individual supplier consents to a 30 October 2026 last service day, with no weekend services. Employment starts 2 November; monthly gross is €4,000, first payday 30 November and December payday 31 December. The no-council work-rules display lawfully began 18 October without observations, allowing effect on 2 November. Later preparation or objections change the schedule.

First employee and first withholding account are separate milestones. Assume prior director remuneration generated €60,000 withholding in 2025, above the 2026 threshold of €51,480: this fixes monthly withholding for the example. Payment is direct or through an ordinary agent; approved social secretariats have different transfer rules. ONSS uses the new ordinary non-construction, one-worker category.

With no alternative replacement fixed through the lawful hierarchy, Sunday 1 November has its default replacement on Monday 2 November. Employment and cover start then; first actual work is Tuesday 3 November.

The tax calendar fixes the withholding dates. DmfA reporting retains the month-end filing rule; the official 2027 payment calendar marks 29 January for the balance. Do not shift that payment to Sunday 31 January. No positive monthly advance arises for this one-worker category under the advance rule. Annual authority filing and employee-copy delivery remain separate; filing does not remit tax.

For local payroll, the City tax list and regional tax scope support scheduling no additional employer-payroll return or payment for this ordinary office case. The City's identified staff-count tax applies to specified drinking-establishment staff, which excludes these facts. Personal municipal income-tax additions and potential office-premises taxes are separate; this is not an exemption from all local business taxes.

Close the contractor engagement and verify first payroll

Procurement/legal and the actual supplier retain the exit/consent record, final services and invoice maturity, expenses/disputes, deliverable acceptance and equipment/access handover. Keep supplier amounts separate from wages.

Inventory earlier IP before relying on ownership. For employee-duty software economic rights, employer ownership is presumed unless agreed otherwise; acquiring commissioned contractor code requires express written transfer. Acquiring ordinary employee copyright also needs express written transfer, with special regimes distinct. Resolve missing earlier assignments separately from the future clause and continuing confidentiality terms.

For first payroll, the agreed owners check:

  • Correct employer, start, holiday/work dates, gross pay and benefit commencement against the accepted offer.
  • Employee deductions, withholding, net bank credit and separate employer charges reconcile; no service period is paid twice.
  • Payslip/account-copy delivery, accepted admission and insurance evidence are retained.
  • Later calendar items remain assigned until each declaration, payment and employee document has its own completion proof.

A future employment contract does not settle earlier employment, tax, social-security or IP liabilities.

Two conversion situations to plan for

Ordinary conversion with booked time off. Suppose the example's worker wants three December days already planned while freelancing. With no earlier employee holiday rights and too little 2026 time to qualify for supplementary leave, the prospective employer agrees three additional paid days in the offer. HR records them separately from statutory leave and calculates next-year rights from actual history. The decision is made before the worker accepts salary and ends supplier service.

Independent-activity permission changes the date. Suppose instead the worker is a non-European professional-card holder in Brussels, with no verified salaried-work exemption. The employer first establishes residence-based employee access or obtains the required approval. The buyer and supplier then coordinate a lawful last-service date with the confirmed employee start. A contractor extension cannot authorise unapproved employee duties.

Questions about converting contractors in Belgium

Can the final invoice be paid after employment starts?

Yes, if it covers earlier services and follows the supplier agreement's payment terms. Mark its service period so it is not treated as employee remuneration.

Must we recognise all contractor service?

Decide the purposes of any agreed recognition explicitly. Genuine supplier tenure and a finding that employment already existed have different consequences.

What changes when the prospective employer is already registered?

It confirms its existing registration and payroll category instead of repeating first-employer setup. Admission and readiness for this worker still need confirmation.

Can we preserve leave booked while the person was freelancing?

Agree the dates and whether each absence uses statutory leave, additional contractual paid days or agreed unpaid leave before the offer is accepted.

Must annual filings be finished before the person starts?

No. Start readiness comes first; quarterly and annual obligations follow on their scheduled dates. Assign their owners before the handoff and retain completion evidence later.
