Can your employee move to New Zealand and stay with the company?
Yes, if their permission covers the proposed work and you establish an employment, payroll and benefits arrangement that fits it. Keeping the existing overseas employer can be possible. A New Zealand employer of record (EOR) is another arrangement to assess, particularly if you want local employment administration.
Start with permission. New Zealand allows qualifying visitors to work remotely for overseas employers, but the current visitor instructions require another lawful visit purpose. That allowance does not establish a permanent relocation route. Employer-specific permission creates different constraints, including when an EOR becomes the employer.
Use four separate approval gates:
Rules checked October 20, 2026. The country guidance below applies to employer retention; the worked example uses Ontario as its stated origin.
Establish the facts before approving the move
Record a short intake summary:
- Origin country and current legal employer, including any existing EOR.
- Current immigration status and the proposed New Zealand permission.
- Destination town, home office or other worksite, and intended arrival and work dates.
- Temporary visit, defined assignment with a return plan, or permanent relocation.
- Actual duties, local clients, contract-signing authority and regulated activities.
- Service date, leave balances, salary currency, benefits, bonus and equity commitments.
A permanent home move and a short family visit need different decisions. A genuine temporary assignment needs a defined purpose, duration, employer and return arrangement; calling it a posting establishes no exemption. Review permission, tax collection, social-security treatment and employment terms separately. There is no universal 183-day safe period across those systems.
For temporary remote visitors, Inland Revenue describes conditional tax exemptions. Their tests differ from immigration permission and depend on more than days. Do not apply them to a permanent move by counting forward from the first flight.
The relevant permission must cover the activity actually performed. A remote employee who begins attending a New Zealand client's workplace can change the answer, even while receiving salary overseas. Ask for an eligibility decision through your authorised process, rather than collecting immigration documents casually in a manager's chat.
Choose the destination employment arrangement
Decide whether the legal employer needs to change before discussing continuity. Record compliant written employment terms, including employer, work, location, hours and pay; applicable minimum rights remain enforceable.
Keeping the overseas employer
Inland Revenue explicitly provides for overseas-employer employees. Where the employer need not register, the employee generally registers as an IR56 worker, unless the employer registers or arranges employment-tax administration. Employee tax collection does not turn the worker into a contractor.
That creates a practical choice: retain the employer and implement the appropriate collection route, including voluntary employer registration where suitable. Check commercial registration separately. An overseas company carrying on business generally must enter the Overseas Register within ten working days of starting that activity. The statutory definition includes exclusions; for example, merely procuring orders accepted outside New Zealand is excluded. Do not infer registration from a home address or payroll choice alone.
Benefits need their own review. Inland Revenue's cross-border guidance warns that amendments expanded fringe-benefit and foreign-superannuation obligations even without sufficient employer presence. Preserving overseas insurance or retirement contributions can therefore create additional accounting duties.
When permission requires an employer
An Accredited Employer Work Visa (AEWV) needs a genuine qualifying offer and approved job from an accredited employer. The visa conditions identify employer, occupation and location; approved triangular placements are expressly possible.
Where an EOR employs the person while your company directs daily work, check the triangular requirements. These include a New Zealand Business Number for the controlling party, except for the specified diplomatic/consular category, plus accreditation and placement safeguards. A foreign client without that number cannot simply assume this route fits. Obtaining a number alone does not satisfy the other requirements.
For an existing AEWV, assess whether an approved Job Change is needed before changing employer, occupation or location. Other employer-specific visas require the applicable variation-of-conditions or new-visa process. Keep the move deferred if the proposed arrangement cannot meet the relevant conditions.
Agree what happens to pay, benefits and existing rights
Use one continuity schedule signed with the employee. Separate statutory entitlements, contractual recognition and balances already paid or still owed.
The hypothetical worked case is an ordinary private-sector employee of an Ontario-based company, employed since December 1, 2023. They work five eight-hour days weekly, earn CAD96,000 annually and have ten unused paid vacation days. Assume valid independent permission for the proposed permanent New Zealand work. The same Ontario company remains the legal employer and chooses New Zealand employer payroll registration.
New Zealand's annual-holiday rules provide four weeks after 12 months' continuous employment. Do not reset service automatically because a payroll system needs a start date. The contractual floor in this example protects immediate leave access. Before approval, reconcile the earlier overseas service, statutory entitlement and holiday-pay valuation; the ten-day assumption is not a legal determination that no additional amount is owed. The opening two weeks are a preserved minimum, remain additional and are not silently absorbed into the next year's allocation. Any greater historical entitlement or pay valuation must be added after reconciliation.
Ontario's ESA scope depends on where work is performed and whether outside work continues Ontario work. Review the permanent move's territorial effect and preserve accrued obligations. The example contains no resignation, dismissal or employer replacement, so November 30 is a payroll cutover, not an invented termination date or automatic vacation cash-out. If the employer actually changes, assess notice, final wages, vacation pay and contractual rights for that transaction before signing a release.
Identical gross salary would not guarantee identical take-home pay. Agree who bears currency changes and document benefits gaps before approval, including dependent cover and any waiting periods.
Coordinate approval, documents and first payroll
The dates below are assumed operational targets for this case, not statutory relocation lead times. Destination work begins Tuesday, December 1, 2026, only after the gates pass.
- November 6: conditional business approval. The business lead approves permanent remote duties; finance records the employer-presence and registration assessment. If local commercial activity changes the assessment, reconsider the arrangement.
- November 13: permission and employee agreement. HR records confirmation of the stated independent permission. The employee and legal employer sign the NZ terms and continuity schedule after an opportunity to review changes. If permission is insufficient, stop the destination start.
- November 20: registrations and payroll mapping. NZ payroll confirms employer registration, employee IRD/tax-code details, deduction treatment and an accepted payroll setup. Canadian payroll obtains a documented decision on Canadian income-tax, CPP and EI treatment. Neither team assumes that moving abroad ends every Canadian deduction.
- November 27: benefits and opening balances. Benefits confirms cover through November 30 and replacement cover effective December 1. Payroll reconciles the ten-day opening bank and November salary. A cover or balance dispute holds unconditional cutover approval.
- November 30: last Canadian payroll payment. Canadian payroll pays the assumed CAD8,000 gross November salary and reconciles deductions. No termination settlement is manufactured; remaining leave and service stay documented with the same employer.
- December 1 to 17: destination start, funding and first pay. Work begins December 1. Treasury's assumed funding cutoff is Friday, December 11; NZ payroll pays NZD5,000 gross on Tuesday, December 15 for December 1 to 15. It verifies receipt and files electronic employment information by Thursday, December 17, under the ordinary two-working-day rule. The second assumed NZD5,000 payment is December 31. Payroll also accounts for December public holidays under the employee’s working pattern; qualifying paid holidays do not use the annual-leave bank. Holiday rights apply without a new annual-leave waiting period. PAYE remittance has a separate deadline.
If a pre-start gate fails, defer New Zealand work and recalculate the origin payroll period, benefits dates and first destination pay together. If funding fails after work begins, the employer still owes the agreed wages; treasury must arrange timely payment and payroll correction. A missed internal cutoff does not suspend employee rights.
Two relocation cases and the costs that change
Case one: independent permission and the same employer
Under the stated assumptions, the company selects direct overseas employment and NZ employer payroll. Final approval for December 1 depends on completing the historical statutory leave reconciliation as well as the other gates. If that decision is unfinished, the move stays deferred and the dated pay plan shifts with it. The employee retains their employer, role and contractual service date, carries two weeks of opening leave, and receives the agreed NZD120,000 annual salary. November wages are settled; leave is preserved rather than treated as a departure payout. Replacement cover starts when the previous cover ends.
The first half-month gross payment is NZD5,000: NZD120,000 divided by 24 instalments. This example demonstrates pay continuity, not net-pay equivalence or a complete employer-cost quote. Canadian outside-Canada payroll rules require separate income-tax, CPP and EI analysis based on the facts.
Case two: permission still needed
Assume another Ontario employee proposes the same permanent move without independent work permission. They suggest arriving as a visitor and moving onto an EOR contract. That proposal fails the approval gate: visitor remote-work conditions are for qualifying overseas work during a lawful visit, and do not establish permission to work for a New Zealand EOR.
The company must establish a qualifying employer-assisted route or another valid permission before the proposed work starts. If an AEWV triangular placement is proposed, test the actual employing organisation, controlling company and approved job against the conditions above. If those conditions cannot be met, defer or decline the permanent move. Continuing the current Ontario arrangement is the outcome until an acceptable alternative exists.
Check KiwiSaver changes and eligibility before budgeting. The default employee rate and ordinary minimum gross employer rate became 3.5% from April 1, 2026. An approved temporary employee reduction to 3% can also be matched by the employer. Eligibility still controls: temporary visa holders cannot join and overseas-employer scope needs separate analysis. Check ACC levy treatment for the selected payroll route too. Do not add a universal contribution percentage to every relocation budget.
What stays with your company after the move
The same manager, team, performance process, promotion path and ordinary collaboration systems can remain. HR should update the work location, payroll responsibilities and escalation contacts while preserving useful employee history.
Keep responsibility for actual work visible. Review client contact, commercial authority, regulated tasks, confidentiality, IP ownership and access to personal data. Assess the home workspace and working hours, including sustainable overlap with the existing team. A service provider still needs accurate hours, leave and compensation decisions from you.
Corporate tax exposure also remains a company question. For the Ontario example, the Canada treaty includes permanent-establishment provisions covering fixed places, specified services and contractual authority. Do not infer immunity from one employee, a home office or an EOR contract. Reopen the assessment if the employee begins local sales, gains authority to conclude contracts or changes worksite.
Questions about keeping an employee in New Zealand
Can we keep paying from our overseas bank account?
Payment location does not settle tax collection or employment duties. Agree the currency and pay cycle, then establish employer payroll or the applicable IR56 arrangement.
Does the employee need an EOR to keep their job?
No universal rule requires one. Independent permission and a supportable direct overseas-employer arrangement can preserve the employer. An EOR requires a separate eligibility and employment-change assessment.
Can we use visitor remote-work permission for a permanent move?
Do not approve a permanent relocation on that basis. Check the lawful visit purpose, duration and permitted overseas activity, and establish permission appropriate to the intended longer-term arrangement.
Does prior service transfer automatically?
Preserve it expressly where agreed, and assess statutory continuity separately. Changing employers and keeping the same employer are different transactions; a new payroll record should not decide legal rights.
Can the employee become a contractor instead?
Relocation alone does not establish genuine self-employment. Retain an employee arrangement where that reflects the work; a label change does not resolve permission or employer obligations.
Borderless AI's EOR service includes employment contracts, payroll and benefits administration. Bring the proposed location, role, permission category and continuity requirements to an arrangement discussion. Confirm New Zealand support for the specific worker and case before committing; immigration approval is a separate decision. For the wider ongoing obligations, see our NZ employment guide.
