Yes, provided the employee can lawfully do the proposed work in the Czech Republic and you establish a suitable employment, insurance and payroll arrangement before work starts there. Retaining the person in your team can involve changing their legal employer. Keeping the overseas employer can also be possible, with obligations that need their own assessment.
The decision becomes harder when residence permission restricts the employer or when an intermediary will employ someone whom your company directs. Czech agency rules and employee-card restrictions can rule out an otherwise convenient arrangement.
Rules checked 20 October 2026.
Can your employee move to the Czech Republic and stay with the company?
Approve the work location only after four separate gates pass. A manager's agreement to retain someone does not establish work permission, and a payroll account does not authorize employment.
For example, EU citizens have free labour-market access; other workers may hold independent access or need permission tied to particular employment. Establish both lawful stay and the right to do this job. A residence document alone does not answer every employment question.
Establish the facts before approving the move
Use a short internal intake, with sensitive evidence handled through your normal secure process:
- Origin country and current legal employer, including whether provincial, federal or collective rules apply.
- Current residence and work-permission category, and the proposed Czech basis.
- Czech worksite, role, regulated duties and authority to negotiate or sign contracts.
- Temporary assignment or permanent move, proposed first Czech workday and any return commitment.
- Existing service date, leave and vacation-pay records, salary currency, benefits, pension, bonus and equity terms.
Duration changes the analysis, but there is no universal 183-day grace period. Immigration, employment registration, individual tax residence, employer withholding and corporate-tax presence have different tests.
The origin also matters. The worked example below uses an ordinary Ontario employee at an Ontario company. Another origin may require different notice, consultation, final pay, social-security or benefit decisions. Even in the Ontario example, a Czech start date does not itself end Canadian tax residence.
Choose the destination employment arrangement
Start with who will actually employ, allocate and supervise the work. Then match that structure to the worker's permission.
Czech agency-employment rules apply where an agency employs someone for a user that allocates and supervises their work. Check the relevant licence, permitted work and validity in the official agency register. A commercial contract describing the arrangement as a service does not settle its classification. The ministry also identifies occupation restrictions for third-country agency placements, with listed exceptions. Check the actual job category before selecting this route.
There is a particularly consequential immigration distinction. An ordinary voluntary change by a dual employee-card holder to an agency employer is restricted. That does not mean all agency employment or every legal succession is prohibited. A genuine statutory business transfer has a narrow court-recognized treatment, discussed in the permission case below. Do not arrange a resignation and new agency contract on the assumption that it qualifies.
Direct foreign employment deserves a separate check. ČSSZ provides a foreign-employer registration mechanism. However, a non-permanent resident working for an employer without a Czech seat may fall outside public health insurance unless an applicable exception or coordination rule covers them. Obtain a coverage determination using the insurer's eligibility rules; intending to stay permanently is different from holding permanent-residence status.
For qualifying foreign-company remote workers, the Digital Nomad Program is another category to assess. It has nationality, professional and other eligibility conditions and preserves foreign employment. Program admission is not a finding that the employer has completed tax, insurance or employment compliance.
For Canada, a coverage certificate is based on qualifying temporary detachment. CRA expressly distinguishes permanent transfers. The bilateral agreement's pension coordination is not a general immigration or health-insurance exemption.
Agree what happens to pay, benefits and existing rights
Consider this hypothetical retention case. An employee with four completed years at an Ontario-based company requests a permanent move. Assume valid independent permission already covers residence and the proposed Czech work. The group has an established Czech subsidiary that genuinely employs and supervises the role. Ontario employment ends voluntarily on 30 November 2026; Czech employment begins on 1 December.
This is an agreed new employment arrangement, with no business transfer or imposed departure assumed. Determine that characterization before signing. Czech statutory transfer rules preserve employment in qualifying cases and cannot simply be excluded by agreement. Ontario also has continuity protections. A group-company move alone proves neither their application nor a universal reset of rights.
The amounts and agreed enhancements are example inputs. Under Ontario's vacation rules, an employee below five years generally earns at least 4% vacation pay. Earned unpaid vacation pay remains payable on quitting. The CAD 2,400 balance must therefore be reconciled from wages and prior payments; ten displayed days do not establish that amount.
Czech private-sector minimum annual leave is four weeks and is calculated in hours. The example's five weeks equals 200 hours for a full qualifying 40-hour-week year. December entitlement follows applicable partial-year rules. It is separate from the settled Ontario balance.
If the departure is imposed or the worker resigns in response to a fundamental adverse change, assess termination obligations. A resignation label does not resolve that issue. A relocation agreement cannot waive Ontario minimum standards.
Coordinate approval, documents and first payroll
The following dates are illustrative operational targets for that case, not promised relocation lead times.
- 20 November, Friday: give conditional business approval. HR records independent work permission; the Czech entity accepts real employer responsibility. Tax and security approve the role and location. If a gate fails, defer the move and revise the origin end date before it occurs.
- 23 November, Monday: complete employment documents. The employee and both employers document the voluntary origin departure, settlement and service recognition. The Czech employer signs the written employment contract, including work type, workplace and start, plus a remote-work agreement. Address hours, safety, expenses and what happens if home working ends. Apply any required consultation first.
- 25 November, Wednesday: complete registration readiness. Czech payroll verifies the subsidiary's existing employer record and fully registers the assumed non-Czech worker through REGZEC. Current foreign-worker reporting requires registration before actual work; filing opens eight days before expected start. A newly registering employer instead has a separate two-working-day deadline before its first worker. Benefits confirms health participation, notifications and the 1 December effective date separately. HR releases final approval after payroll and benefits confirm readiness.
- 30 November to 4 December: close origin payroll and start locally. Ontario employment and assumed origin benefits end Monday 30 November. Czech employment and confirmed destination coverage begin Tuesday 1 December. Ontario payroll pays remaining wages and the CAD 2,400 gross vacation balance on the assumed regular payday, Friday 4 December, with deductions and a wage statement. Ontario's final-pay deadline is the later of seven days after employment ends and the next regular payday: Monday 7 December here. Payroll also determines required Canadian reporting and any later bonus/equity treatment.
- 18 to 31 December: fund and verify Czech pay. Finance uses an assumed Friday 18 December funding cutoff and treasury confirms the bank calendar. Payroll processes December's CZK 100,000 gross salary, deductions and benefits for the agreed Thursday 31 December payday. It verifies receipt and the payslip. Czech wage-payment rules require a regular payday within the statutory maturity period; 31 December is this employer's chosen date, not a national requirement.
Payroll must also schedule monthly reporting and contributions. JMHZ does not replace separate health-insurer duties.
If registration or coverage is incomplete before first work, postpone the Czech start. Coordinate both employers' documents and benefit dates; do not silently leave the employee between employment relationships. Once work begins, a missed commercial funding cutoff does not postpone earned wages.
Two relocation cases and the costs that change
Case one: independent permission and an operational subsidiary
The case above can proceed on its stated facts: the legal employer changes from the Ontario company to its Czech subsidiary, while group collaboration continues. The Ontario liability is paid, defined service benefits are recognized by agreement and Czech leave accrues under local rules. No fresh probation is agreed.
The employee's short December presence does not create an automatic tax exemption. Under the Canada-Czech tax convention, the short-stay employment exception has cumulative conditions, including a nonresident employer. A Czech-resident subsidiary fails that employer condition even if the employee remains Canadian treaty-resident.
Case two: permission must be obtained or changed
Assume another Ontario employee wants the same move but lacks permission for the proposed Czech employment. An agency EOR contract is not sufficient approval. Assess an eligible initial application or another lawful route, and defer Czech work until its requirements are satisfied.
If the plan later involves voluntarily switching a dual employee-card holder to an agency employer, the employer-change restriction becomes decisive. There is a narrow distinction for genuine statutory succession: the Supreme Administrative Court's 2023 transfer decision addressed a legal employer change through a business transfer with the job unchanged. It does not turn an ordinary resignation and rehire into an exception. Where no permitted route fits, decline or defer the requested work location while retaining the current arrangement if feasible.
For an ordinary covered office role, employer social insurance at 24.8% and employer health insurance at 9% would add CZK 33,800 to the example's monthly salary. CZK 133,800 is a subtotal before accident insurance, benefits, expenses and administration. It assumes the full salary is assessed at those ordinary rates without a cap or discount affecting it. Use the Czech hiring-cost guide for deeper budgeting. Equal gross pay across countries does not assure equal take-home pay.
What stays with your company after the move
The same collaboration tools, email, performance cycle and promotion process can remain familiar. HR should keep both the original group service date and the correct legal-employment record. In the subsidiary case, the Czech employer must retain genuine authority over the role, even where group colleagues collaborate closely.
Keep ownership of compliance inputs inside the company. Security approves data access and IP arrangements; the business lead reports changes in clients, duties and signing authority; HR routes pay rises, promotions and future moves through the legal employer.
Czech tax guidance distinguishes home working from tax presence: employment or a home office alone does not automatically create a permanent establishment, but management, contractual authority and actual business activities can change the outcome. Local payroll or EOR employment does not settle your company's exposure. Reassess before granting commercial authority or approving another country.
Questions about keeping an employee in the Czech Republic
Can we leave the employee on the existing overseas contract?
Possibly, through a suitable foreign-employer arrangement. Document the Czech workplace, applicable terms, registrations, permission and insurance. If the legal employer stays the same, use the appropriate amendment and payroll changes; do not invent a termination solely because the address changes.
Does independent work permission remove employer obligations?
No. It can clear the worker-permission gate while leaving employment documents, pre-start reporting, payroll and insurance duties. For the broader obligations, see our Czech employment-law guide.
Must prior service and unused leave transfer automatically?
The transaction determines statutory continuity. Where it is a genuine new employment arrangement, specify contractual recognition and settle origin entitlements as required. Keep paid-out balances, statutory destination accrual and additional agreed leave distinct.
Can we approve a short trial period from Prague first?
A shorter stay still needs a lawful work basis and the relevant employer arrangements. Establish those before the trial starts. A future permanent approval cannot retrospectively authorize work.
Is contractor status an easier way to retain the employee?
Changing the label does not resolve an employment relationship. Choose a route reflecting the actual work and supervision rather than converting the employee merely to accommodate the move.
Borderless AI's EOR service covers employment contracts, payroll and benefits. Bring the proposed role, work-permission category and continuity requirements to an arrangement assessment. Confirm Czech case eligibility and the actual employing structure before committing to the move.
