Yes, you can retain an employee moving to Belgium when their permission, employment arrangement and payroll support the proposed work. Approve the move only after agreeing what happens to existing service, leave, pay and benefits.
Belgium makes the choice of legal employer especially important. Direct employment by an overseas company deserves consideration. A third-party arrangement needs a separate check against Belgian restrictions on hiring out workers. Neither route automatically supplies immigration permission.
Can your employee move to Belgium and stay with the company?
Treat permission to relocate and permission to start working from Belgium as separate decisions. A manager can support the request while HR makes approval conditional on the following evidence.
Belgium distinguishes residence rights from authorization to work. For many non-European employees staying and working for more than 90 days, the relevant process is a single permit, with work and residence components. Exemptions depend on the person's situation. Check the proposed activity and employer against the actual permission, rather than treating a residence card as universal clearance.
Establish the facts before approving the move
Start with a short factual intake:
- Origin and employer: current work country, legal employer and whether employment will continue with that same organization.
- Permission: the verified basis for Belgian residence and work, its expiry and any restrictions.
- Destination: municipality, region, home office or other worksite, and any work in other countries.
- Role: actual duties, client visits, regulated activities and power to negotiate or sign contracts.
- Duration and date: permanent move or defined assignment, intended Belgian work start and credible return plan where relevant.
- Existing rights: original start date, leave, salary, benefits, bonus, equity and any protected or collectively agreed terms.
These answers determine which authority and employment rules apply. In Flanders, when an employer has no Belgian office or establishment unit, the place of activity determines the competent region. Multi-site arrangements require their own allocation check.
Regional processes also differ. Brussels guidance says work-permit applications for non-European nationals have used the federal One-Stop counter since May 4, 2026. Wallonia identifies category-specific conditions and a mandated Belgian representative for employers established abroad. The German-speaking Community describes its combined permit as tied to both employer and occupation. Use the authority for the actual work arrangement.
A return date must reflect the real plan
Belgian posting guidance requires temporary work and a pre-existing employment relationship that continues throughout the posting. Permanent employment in Belgium falls outside that definition. Labour-law posting and social-security posting are separate assessments.
A personal move with no meaningful return plan should therefore be assessed as an ongoing Belgian work arrangement. Calling it a six-month trial does not establish posting eligibility. Nor does staying below 183 days settle work authorization, social security or company tax exposure.
Choose the destination employment arrangement
Select the route using the work facts, then verify its administrative and immigration requirements.
Belgian NSSO instructions explicitly recognize foreign employers with staff in Belgium and no Belgian operating establishment. Assess the actual establishment category: a permanent home workplace may require a Belgian establishment-unit registration even when no subsidiary is incorporated.
For Belgian social-security employment, the employer uses WIDE identification. The NSSO instructions require a Crossroads Bank for Enterprises number for employer identification. Access, mandates and payroll administration still need arranging. An overseas payroll payment alone does not complete these obligations.
Check who will exercise employer authority
Article 31 generally prohibits worker supply involving a transfer of employer authority outside the statutory framework. Official hiring-out rules distinguish genuine services from prohibited labour supply. Permitted client instructions must be detailed in writing, match actual practice and preserve the employer's authority; representative-information duties may also apply. Temporary agencies require recognition and must operate within their legal conditions.
Before choosing an EOR, establish who controls leave, discipline, working arrangements and dismissal, and which instructions the company may give. Obtain a case-specific explanation of the lawful structure. If it cannot support the intended relationship, assess direct employment or another valid route. Do not substitute a contractor label for an employee's unchanged job.
Agree what happens to pay, benefits and existing rights
Consider this hypothetical case, carried through the next two sections. An ordinary private-sector employee works in Ontario for an Ontario-based company, which will remain the legal employer after a permanent move to Brussels. The employee has valid independent residence and work permission covering this employment. This is a premise, not real-worker verification.
Assume the employer completes the required foreign-employer registrations, establishment assessment and Belgian payroll setup. Employment began November 1, 2019. Belgian terms take effect November 1, 2026. The signed amendment makes these decisions:
These are hypothetical ledger balances. The three statutory days and eight extra days are separate from the CAD 2,400 money balance. Ontario allows vacation pay at an agreed time with the employee's written or electronic agreement. Payment does not waive vacation-time rights or discharge unidentified balances.
Belgian ordinary holidays principally reflect prior-year work and equivalent periods. Qualifying starters can obtain supplementary holiday rights after a minimum three-month activity period. In this example, payroll records the actual Belgian statutory entitlement separately; the company-funded eight-day balance bridges the transition without representing an immediate statutory allowance.
A retained start date does not settle every statutory benefit. Rome I rules protect mandatory rights despite a foreign-law clause. If another route changes the employer, assess business-transfer rules and any required consultation rather than assuming protected continuity. Document additional contractual recognition without reducing mandatory rights.
Check the joint committee and sector wage terms. EUR 5,000 is a base salary, not a total employment budget or guaranteed net income. Ordinary Belgian probation clauses are invalid, subject to specific regimes; the amendment does not introduce one.
Coordinate approval, documents and first payroll
Use this sequence to produce the dated release below:
- HR and manager approve conditionally. Fix role, workplace, budget and date. For the example, no Belgian sales mandate or regulated activity is added.
- Immigration and employment leads clear the route. Confirm independent permission for this work and the continuing employer's registration requirements. Prepare conditional documents where an application needs them.
- HR and the employee sign the amendment. Record the table's decisions and any required consultation. Determine the applicable document language; Brussels generally uses French for French-speaking staff and Dutch for Dutch-speaking staff.
- Payroll and benefits complete setup. Obtain worker/employer identifiers, accepted enrollments and insurance. For Belgian-covered employment, submit Dimona before work starts and arrange accident cover from day one. DmfA quarterly reporting remains separate.
- Origin payroll closes its period. Reconcile wages, vacation money and bonus; retain the continuing employment record. Review Canadian overseas deductions and tax residence, without simply cancelling all Canadian obligations.
- Finance funds; payroll verifies receipt. Confirm gross-to-net treatment, bank details, payslip and employee receipt. Belgian pay-date rules distinguish collective agreements, work regulations and the four-working-day fallback; bank payment is made when the employee's account is credited.
For regular private-sector telework, CBA 85 requires individual written terms by commencement, including location, availability, support and expense arrangements. In the example, the employer supplies the laptop and pays agreed work-related connection costs.
Two relocation cases and the costs that change
Case one: independent permission and continuing direct employment
The Ontario employer remains the employer throughout. October's last origin payroll pays CAD 12,400 gross: CAD 8,000 salary + CAD 2,400 vacation pay + CAD 2,000 bonus, before applicable deductions. November's first Belgian payroll pays the agreed EUR 5,000 monthly base, with applicable adjustments and statutory deductions separately calculated. No currency conversion or net-pay comparison is implied.
All dates below are hypothetical 2026 targets and commercial cutoffs, not processing-time guarantees. Assume a Monday-to-Friday schedule and an applicable replacement holiday fixed on November 2 for All Saints' Day, which falls on Sunday, November 1. Belgian holiday rules require replacement of a holiday falling on Sunday or an ordinary inactive day. Consequently, the first scheduled Belgian workday here is Tuesday, November 3, while pay and coverage start November 1.
If the October 29 registration or insurance gate fails, HR does not release the Belgian work arrangement. With the employee's agreement, they remain working in Ontario on their existing terms and coverage while the date is reset. October wages remain due; any signed balance-payment commitment is honored. Do not activate the EUR salary or end origin cover independently of the revised agreement. If the employee moves anyway, do not permit Belgian work until the missing gate is cleared.
The continued-employment example creates no termination payout merely because payroll changes. If a different route actually ends Ontario-covered employment, final wages, including vacation pay, are due by the later of seven days after employment ends and the next regular payday. Assess Ontario scope, notice, benefit and consultation duties from the real facts.
Case two: permission or employer change remains undecided
Assume the same Ontario origin and a proposed Belgian move, but no independent work permission. Keep approval conditional while the proposed employer and role are assessed. No approval is assumed.
Flanders' published employer-change process requires new-employer authorization for ordinary employer-specific permits and identifies distinct Blue Card and seasonal rules. However, EU Article 11 also establishes employer-change rights subject to defined conditions and limits a notification-based suspension to 45 days. Establish the operative procedure and any applicable EU-law remedy for the category; do not present administrative guidance as an unlimited bar or treat a pending application as permission to start.
If the required initial permission or employer-change clearance is unavailable by the intended work date, defer Belgian work, change the plan or decline the request. An EOR agreement cannot substitute for the missing permission.
For fuller budget components, see our Belgium hiring-cost guide. Use the actual arrangement when deciding whether the retention budget works.
What stays with your company after the move
Keep familiar team membership, email, SSO access and performance discussions where the approved structure and security rules permit. Record the legal employer separately in HRIS. If a third party employs the worker, route employment decisions through the agreed authority boundaries.
Your company must still provide accurate work-location, hours, absence, compensation and role-change inputs. Reassess promotions, client responsibilities and signing powers before they take effect. Identify ownership and licensing of work product, access to customer data and any restrictions on regulated work.
Tax presence remains a separate company decision. The Canada-Belgium treaty addresses permanent establishment and employment income separately. Its employment-income exception combines a day-count condition with employer-residence and cost-bearing conditions. It supplies no universal 183-day exemption from relocation obligations. Have the tax lead assess the actual activities and applicable treaty position, including subsequent amendments, before expanding Belgian commercial authority.
Questions about keeping an employee in Belgium
Can the employee start working while a permit application is pending?
Only if their existing permission independently covers the proposed work. Submission alone is not clearance. Check both work and residence conditions for the actual employer and category.
Must we open a Belgian subsidiary?
Assess direct foreign-employer registration first. A separate Belgian company is not the only employment structure to investigate. Registration still leaves local employment, tax and work-permission questions to resolve.
Will five years of company service automatically count with a new employer?
No single HRIS date establishes every entitlement. Assess statutory continuity and specify any contractual recognition for notice, leave and company awards. A change to payroll alone is not a new legal employer.
Does keeping the same gross salary preserve take-home pay?
No. Obtain a Belgian payroll projection and compare annual compensation, deductions and benefits. Agree any company commitment to offset a difference explicitly.
Can an EOR guarantee approval of the move?
The employment arrangement, immigration eligibility and company approval require separate evidence. Ask for confirmation of the proposed Belgian structure and authority allocation before committing.
Borderless AI's EOR service covers employment administration including contracts, payroll and benefits. Discuss the proposed Belgian employer, work permission and continuity schedule with us to assess whether an appropriate arrangement can support retaining your employee.
