Key Takeaways

  • An employee may remain with the same foreign employer after moving to Sweden through appropriate Swedish arrangements; permission, branch requirements, tax presence and payroll are separate decisions.
  • An EOR can fit an eligible arrangement, but covered agency assignments can trigger an offer-or-compensation duty after more than 24 months within 36 at the same operating unit.
  • Preserve service, earned leave and vacation pay, current-year accrual, benefits and awards item by item. A payroll-location change does not create a resignation, termination payout or automatic rights reset.
  • Keep move approval conditional on work permission, registrations and effective cover. No universal 183-day rule or EOR contract bypasses those gates, and missed funding does not remove wage obligations.

Yes, you may be able to retain an employee who moves to Sweden. The decision depends on their permission to live and perform the proposed work, the employment arrangement, Swedish payroll readiness and the treatment of existing rights.

Sweden offers an option that can avoid changing the legal employer: a foreign company can register for Swedish employer obligations. That still leaves separate questions about branch registration, corporate tax and employment terms. An employer of record may be another arrangement, subject to the worker and assignment being eligible.

Can your employee move to Sweden and stay with the company?

Give conditional approval first. Make permission to begin Swedish work depend on four separate decisions, with evidence and an accountable owner.

QuestionEvidence neededDecision ownerIf unresolved
Does the company approve this work location?Role, duration, worksite, customer activity, data and tax-presence assessmentBusiness leader with tax and security leadsKeep the approved work location

Can payroll and benefits operate from the effective date?Employer registration, withholding treatment, contribution classification, benefits and payment testPayroll leadMove the work-start date

The Migration Agency requires employers to check the right to work. A residence document, population registration and payroll registration answer different questions. None should be treated as proof of all the others.

Establish the facts before approving the move

Record these facts in an internal relocation brief:

  • Current country and work location, legal employer and employment start date.
  • Existing residence/work permission and whether it covers the proposed Swedish work.
  • Swedish location, home or client worksite, role and customer responsibilities.
  • Temporary assignment or permanent move, proposed dates and any expected return.
  • Salary/currency, earned leave, notice terms, pension, insurance, bonus and equity commitments.

EU/EEA citizens can work without a work permit, but residence beyond three months must meet the right-of-residence conditions. For a permit-dependent worker, identify the exact employer and occupation restrictions before agreeing to continuity.

A permanent Sweden base also changes the employment-law analysis. Under Rome I, choosing Ontario law cannot remove mandatory protections that would otherwise apply under Article 8. Temporary work with an expected return needs a different assessment.

For the origin side, an Ontario employer's address alone does not decide whether Ontario employment standards continue to apply abroad. The actual work pattern matters under the province's territorial rules. Separate accrued obligations, continuing contractual promises and prospective statutory coverage.

Choose the destination employment arrangement

Choose the arrangement after checking permission, rather than assuming a payroll solution creates immigration eligibility.

Keeping the foreign employer

The Tax Agency provides a foreign-employer mechanism. For a foreign employer without a Swedish permanent establishment, withholding guidance covers work from a Swedish home. The default deduction is 30% unless the agency decides otherwise; this is preliminary withholding, not the employee's final tax rate.

Sweden's foreign-branch law requires a separate assessment of the actual business activity and registration needs. A Swedish branch remains part of the foreign company, so registering one does not itself replace the legal employer.

Social insurance needs its own decision. The bilateral agreement starts with work-country coverage and contains a conditional employer-sent detachment exception. Keeping a Canadian employer does not automatically create a 60-month exemption. A Canadian coverage certificate and an EU A1 are different mechanisms. Likewise, Swedish labour-law posting guidance requires a limited assignment and a Swedish service recipient.

Using an EOR

Assess the substance of the arrangement. Sweden's Agency Work Act covers workers employed for assignment under a client's control and direction. Where applicable, it imposes duties on both parties. Its same-operating-unit rule can require a permanent-employment offer or compensation after more than 24 months within 36 months, subject to statutory scope and permitted collective-agreement deviations. Obtain a written applicability assessment for the proposed remote arrangement; the EOR label alone does not answer it.

Agree what happens to pay, benefits and existing rights

The following worked case is hypothetical: an ordinary private-sector employee moves permanently from Ontario to Sweden. They have valid independent residence and work rights for this exact arrangement. The same Ontario corporation employs them before and after the move, with Swedish registration and any required branch arrangements completed. No real worker's eligibility is implied.

They started on October 24, 2022, earn CAD 8,000 monthly before the move and have five unused earned vacation days plus CAD 2,000 associated unpaid vacation pay from a completed calendar-year 2025 entitlement period. These are assumed audited balances, not a formula for valuing everyone's leave.

Ontario ordinarily requires vacation within ten months after the entitlement year. For this assumed calendar-year balance, October 31, 2026 is the deadline. Paying cash does not by itself erase the time entitlement: Ontario's vacation guidance distinguishes the two. This case uses the leave before the move, rather than inventing a cross-border transfer of five days.

Sweden's Annual Leave Act generally provides 25 leave days per holiday year, with paid entitlement depending on earning. Its default holiday year runs April to March. Do not treat this continuing employee as a new hire with automatically reset earnings. The company-funded bridge addresses the transition without replacing statutory rights or erasing origin balances.

If a different legal employer takes over, assess statutory continuity first. The Employment Protection Act protects specified group changes and qualifying business transfers; ordinary contractual service recognition is a separate matter. A relocation alone does not prove that a business transferred.

Coordinate approval, documents and first payroll

These dates are assumed operational targets for the hypothetical case, not promised processing times. All are in 2026. HR's relocation lead owns the combined decision, while each specialist signs off their part.

  1. By October 23, approve the arrangement and permission. The business leader approves the role/location; HR verifies the independent-rights premise. Legal completes the branch, employment-law and consultation assessment. Any required union negotiations precede the relevant decision under Sweden's co-determination rules. If permission or a necessary registration is unresolved, defer Swedish work.
  2. October 23, sign the amendment and pay legacy vacation pay. HR and the employee agree the November 2 worksite/payroll change, service record, leave bridge and benefits. Ontario payroll pays the audited CAD 2,000 before the October 26 to 30 leave. Changed written particulars under LAS section 6e are due no later than the effective change date; signing earlier is this company's cutoff.
  3. October 30, make the last Ontario-location payment. The assumed employment terms and audited payroll reconciliation establish a total October entitlement of CAD 8,000: CAD 2,000 vacation pay already paid, plus CAD 6,000 remaining gross. Preserve any separately owed salary; arithmetic alone cannot establish the entitlement. Payroll separately records current-year accrual, bonus liabilities and Canadian withholding/reporting treatment. This is a payroll-location cutover, not final termination pay.
  4. Before November 2, activate Swedish payroll and benefits. Payroll holds the employer-registration confirmation, employee tax treatment, contribution classification and tested payment details. Benefits confirms the November 2 start and November 1 end of origin employer-plan cover. The employee completes applicable population/social-insurance notifications; Försäkringskassan determines relevant coverage. Pending administration must not conceal an unfunded benefit gap.
  5. November 2, begin Swedish work. The manager keeps the role and reporting line. HR records the same employer and original start date. The five legacy days and CAD 2,000 legacy pay are now cleared; current-year rights remain recorded separately.
  6. November 18 and 25, fund and verify first Swedish pay. Finance funds by the assumed November 18 cutoff. Payroll delivers the agreed SEK 60,000 November gross on November 25, with the approved deductions and benefit entries. It checks receipt, payslip and the following reporting/remittance calendar using the employer's assigned PAYE category.

If a gate fails, change the November 2 Swedish work-start and affected benefits/payroll dates together. Keep lawful work at the existing approved location where feasible. A late payment file does not authorize ignoring the wage obligation once Swedish work has started.

Two relocation cases and the costs that change

Case one: independent permission, same employer

The Ontario employee above stays employed throughout. The legacy 2025 leave is used and paid, the original service record remains, compensation changes by agreement, and benefits switch on the documented date. Foreign-employer registration supports the Swedish payroll arrangement; it does not certify permission, branch compliance or the absence of corporate tax exposure.

The company accepts ongoing Swedish administration rather than paying an EOR fee. That can be a reasonable retention choice when it can own those duties. Identical gross pay would not establish identical take-home pay, pension or insurance.

Case two: permission still needed

Assume a second Ontario employee has the same job but no independent right to live and perform it in Sweden. Their move remains conditional. A foreign employment relationship is not categorically excluded by the Aliens Act, but payroll registration alone does not establish a qualifying immigration route for a foreign-only remote role.

The employer must establish the relevant residence/work route and satisfy its current requirements. Sweden changed ordinary work-permit requirements from June 1, 2026, including salary and employer-related conditions, with transitional rules. An EOR contract does not bypass those requirements. If no supported route is established, defer or decline the Swedish work arrangement while retaining the employee at their lawful current location where possible.

What stays with your company after the move

Keep the manager, team, performance reviews, promotion process and company systems familiar where your access rules allow. Update the HRIS with the actual work location, legal employer, payroll and benefit records. Route future salary, role and location changes through the responsible employment/payroll owner.

The company still supplies accurate facts about customer work, contracting authority, home-office use, regulated duties, IP and data access. A Swedish home office or actual contracting activity can affect permanent-establishment analysis. Employers also retain remote-work environment duties. An EOR arrangement does not replace these company inputs.

The next decision is whether the company can own direct employer administration or needs another eligible arrangement. Assign an escalation owner for any change that invalidates the original approval.

Questions about keeping an employee in Sweden

Can we keep paying through Canadian payroll?

Keeping the Canadian legal employer may work. Keeping only the old deductions and reporting is a different decision: Swedish work can require Swedish withholding, contributions and monthly reporting.

Does staying under 183 days make the move safe?

No single day count settles immigration, employment law, social insurance, payroll and corporate tax. A limited-stay tax exception has its own conditions and does not approve a permanent relocation.

Does relocation require termination pay in Ontario?

Not automatically. This example continues the same employment. If employment actually ends, Ontario's payment deadline is the later of seven days after ending and the next regular payday, with applicable termination obligations assessed separately.

Can an employee change employers on a Swedish work permit?

Check the actual permit conditions first. An employer or occupation change can require a new application. The Migration Agency's rules distinguish permit categories and circumstances; qualifying existing-permit holders may work while an application is pending. That exception does not approve a first Swedish move.

Can we preserve benefits and service through an EOR?

Agree each item explicitly and check any statutory continuity first. A recognized company start date does not establish every statutory entitlement, pension right or insurance benefit.

Borderless AI offers EOR employment administration, including contracts, payroll and benefits. Bring the employee's role, permission basis, move date and continuity requirements for an arrangement assessment. Confirm Sweden and case eligibility before relying on a proposed solution.
