Key Takeaways

  • Establish whether the legal employer stays the same, CBA 32bis applies, or a lawful agreed exit and new employment are needed before asking an employee to resign.
  • Validate the incoming Belgian structure under worker-supply rules and the actual worker's permission. A licence, service cancellation or residence card alone does not establish a lawful cutover.
  • Reconcile statutory continuity, contractual service recognition, holiday days and money, protected leave and accepted benefits separately; the worked holiday-pay offset prevents paying the same component twice.
  • Clear consent, minimum verified records, benefits and funding before exit. Fund B independently of A's unreceived refund, and defer the cutover if decisive evidence is missing.

To switch EOR providers in Belgium, identify the legal employers, test transfer protection and validate the incoming arrangement. Then coordinate rights, employee documents, work permission, benefits and payroll around one conditional date.

A provider's proposed onboarding date cannot settle those questions. Belgium restricts lending workers to a client that exercises employer authority, and a qualifying business transfer follows different rules from ending employment and signing a new contract. Resolve the mechanism before asking anyone to resign.

Rules checked 20 October 2026. This guide addresses ordinary private-sector employment, with regional and worker-category differences identified below.

What changes when you switch EOR in Belgium?

Compare the employment contract, payslip and social-security employer details with the incoming documents. Record each legal entity's name, enterprise number and ONSS/RSZ identification. A brand or platform name may conceal the same local employer. An entity lookup helps identify the parties; it does not establish a transfer mechanism.

Different employers; no qualifying statutory transferAgreed exit and new employment, or another specifically validated consensual arrangementLegal assessment, required worker agreement, incoming terms and settlement scheduleStatutory continuity cannot be assumed; specify recognized service and settled liabilities

Under the federal transfer guidance, an economic entity must retain its identity. Keeping the same client and job is insufficient by itself to establish that test. Equally, the absence of a direct sale agreement between providers does not automatically rule it out: the ministry recognizes indirect contractual transfers. Have the Belgian employment adviser document the facts supporting the chosen route.

Check the incoming arrangement's legal basis

Belgium's worker-lending law generally prohibits supplying staff to a user that exercises part of the employer's authority, outside lawful exceptions. An unlawful arrangement can expose the client to deemed indefinite employment and joint liability. A replacement provider does not erase that exposure.

For Flanders, the government's EOR warning specifically points employers toward licensed temporary-agency requirements. Request the relevant licence and the permitted assignment basis. A licence alone does not establish that an indefinite assignment is allowed.

A genuine services arrangement requires actual employer authority to remain with the service employer, with detailed written limits on client instructions and applicable representative information. Relabelling ordinary staff supply does not establish that arrangement. The exceptional Article 32 route has limited-duration and other conditions; it is not a general authorization for a business whose normal activity is lending staff.

Obtain written confirmation of the route, territory, worker category, permitted duration and who exercises which authority. If the incoming provider cannot substantiate the arrangement, change the plan before employee exits. A direct-employment alternative may need assessment, but requires its own registration and tax analysis.

Review the existing service and employee position

Keep EOR A's employment obligations separate from the client's service contract: vendor cancellation is not employee notice.

Commercial agreement checklist

  • Identify notice length, service method, renewal dates, minimum commitments and exit charges.
  • Confirm export assistance, post-exit payroll corrections, deposit deductions and refund conditions.
  • Allocate outstanding invoices, claims, indemnities, funding and delayed benefit charges.
  • Agree what happens if the proposed switch date moves, including any lawful extension with A.

Employee arrangements checklist

  • Establish the legal employer, contract type, original employment date, recognized service and applicable joint committee.
  • List pay, working hours, bonus and equity documents, statutory and contractual leave, insurance and pension arrangements.
  • Flag sickness, maternity, parental leave, time credit, representative protection, disputes and outstanding claims.
  • Verify work/residence permission, any assignment authorization, payroll cutoffs and the employee's bank and social-security identifiers through a secure process.

Confirm document language and sector terms before preparing documents; our Belgium employment guide covers the wider duties.

Establish transfer and continuity treatment

Where CBA 32bis applies, the ministry confirms automatic contract transfer: a new employment contract is not needed to make the transfer happen. Consent is not the transfer trigger; the worker-position guidance explains the treatment of refusal and substantial detrimental changes.

Outside that mechanism, do not present a client instruction as consent to change employers. One possible route is a mutually agreed end with A followed by agreed employment with B. Belgian mutual-exit guidance permits the parties to set exit conditions, with or without compensation, and recommends writing them down. Explain the worker's consequences before seeking agreement. If agreement is unavailable, A must establish the applicable lawful termination route rather than treating vendor cancellation as dismissal authority.

ImmigrationPermission may be employer-linked, with category-specific exceptionsSecure the required approval or notification and lawful start dateB's immigration owner; employee supplies documents

The ministry's individual-terms guidance distinguishes preserved contractual rights from supplementary pension, survivor and invalidity arrangements. Do not promise that every insurance or pension plan automatically moves. If joint committees differ, map the consequences individually: the collective-terms guidance identifies difficult questions about continuing sector terms and incorporated contractual rights.

ONEM's employer-change guidance also distinguishes ordinary employer changes from protected transfers. A generic promise to recognize seniority cannot by itself continue a time-credit approval or allowance.

Set one coordinated cutover calendar

Use three linked calendars: vendor cancellation, employment continuity or exit, and payroll/reporting. Their dates can differ. For a qualifying transfer, complete the applicable prior information and consultation. CBA 32/8, effective 1 February 2025, also requires on-request information to the identified transferee and an invitation to introduce itself before transfer.

Worked case: a conditional 1 December cutover

Assume a Belgian national, an ordinary white-collar employee working Monday to Friday. The example proceeds only if advisers establish that no qualifying economic entity transfers and that B's actual services arrangement lawfully retains employer authority. A and the worker freely agree an exit; B agrees new employment. These conditions do not establish every switch’s mechanism.

All dates are illustrative 2026 dates. Assume the service contract accepts 30 calendar days' notice, received Friday 30 October, for cancellation after Monday 30 November: 31 elapsed days. This is commercial notice, not employee notice. Assume lawful agreed pay dates: A settles its 1 to 30 November wage period on 30 November; B pays 1 to 31 December on 31 December. A's benefits end 30 November; B's accepted coverage begins 1 December. Assume no substitute holiday on the selected work/leave dates; Belgian holiday rules require checking sector substitutions and replacement days.

Under ONSS guidance, start notification precedes work; exit notification is due no later than the first working day after departure. For this assumed ordinary calendar, A's deadline is Tuesday 1 December. Filing OUT/IN does not itself determine statutory continuity.

Make permission a separate dependency

Flemish guidance describes a new employer application and authorization for ordinary employer-linked cases, plus a specific acquisition/merger/takeover continuity exception. Walloon guidance also distinguishes limited permits from unrestricted access.

Check those procedures against the recast Single Permit right to change employer under conditions. Belgium's 30 September tracker listed transposition as unfinished. B must establish the current applicable procedure and lawful start date, including EU-law implications, rather than treat older administrative wording as conclusive.

Categories differ. The Brussels Blue Card rules require notification: during the first year of covered employment, starting is allowed 30 days after sending the required documents provided no refusal is notified; after one year, starting can follow transmission. Identify the competent region, including the German-speaking Community where relevant. A residence card alone does not settle permission to work for B.

Reconcile transition costs and cash

Separate employee entitlements, provider charges and recoverable funding. No fee or refund timetable below is universal.

The worker's four-day holiday reconciliation

Belgian holiday-pay instructions distinguish ordinary white-collar exit-pay offsets from blue-collar holiday-fund and special temporary/agency treatment. The ordinary post-2024 method uses advances for covered holiday, followed by December or departure reconciliation; definitive daily reconciliation is also possible.

Assume A's validated final certificate allocates EUR 600 of already-paid simple exit holiday pay to four remaining 2026 days. The worker takes Monday 7 to Thursday 10 December. Assume B's payroll validates normal gross holiday pay of EUR 200 per day and uses the advance method.

Four-day itemCalculationPayer and treatment
Normal gross holiday entitlement4 × EUR 200 = EUR 800Reconciliation target, not an extra payment
Advance from B10% × EUR 800 = EUR 80B pays through December payroll
Final December top-up from BEUR 800 − EUR 80 − EUR 600 = EUR 120B pays the positive balance
Total covering these four daysA's EUR 600 + B's EUR 80 + EUR 120 = EUR 800No second EUR 600 payment by B

These are assumed gross amounts, not a statutory daily rate or net-pay forecast. B contributes EUR 200 in total for this holiday component. December working-day wages, double holiday pay, future-year accrual, tax and contributions remain separate. A's historical year-to-date figures support reconciliation; they are not new B earnings or new funding. Explain the advance/offset before the worker plans December spending.

Test the first payroll and close the old arrangement

Parallel testing compares calculations; only the assigned payer releases each live wage component. Use pass/fail checks:

  • Periods: A owns November, B December. Account for every day, absence and component once.
  • History: Reconcile service, category, relevant year-to-date remuneration, deductions and contributions; keep A's reported history distinct from B's live reporting.
  • Calculation: Confirm salary, sector/indexation, benefits, withholding, social contributions and the EUR 800 holiday reconciliation from validated inputs.
  • Coverage: Match insurer acceptance and benefit start/end dates, including waiting conditions or exclusions.
  • Filings: Retain Dimona acknowledgements; assign quarterly DmfA, withholding returns/payments and annual tax documents to the responsible employer or mandatary. FPS Finance treats withholding declaration and payment as separate debtor duties.
  • Cash and closure: Match payslips to bank receipts, payroll funding, final invoices and deposit reconciliation; name owners for later corrections.

Give the employee a usable handoff

On 18 November, explain the legal employer change, agreed exit, B's service recognition and benefits dates. Distinguish statutory entitlements from contractual recognition and insurer acceptance. Send A's draft settlement, B's terms, rights comparison, privacy information and the holiday-pay illustration.

The 25 November review target is an assumed planning date, not a statutory consent period. Give access to A's employment contact, B's payroll/benefits owner and the client's HR lead; allow questions and independent advice. If agreement is absent, move the date rather than infer consent. Under a qualifying CBA 32bis transfer, use the applicable transfer-information process instead of manufacturing an exit-signature requirement.

At exit, A provides the applicable social documents, including final-payment details and required holiday documentation. Schedule later documents at their legal deadlines. B explains the first payslip and resolves discrepancies with the worker.

If A delays or refuses records

B's payroll lead owns a minimum-records check before 27 November: verified identity/national-register or BIS number; contracts and amendments; service/sector/category; current pay, hours, benefits and absences; relevant YTD wages/deductions/contributions; holiday days and paid amounts; permission where relevant; and reporting/payment responsibilities.

Use the worker's copies and authorized payroll or insurer records only through a lawful secure route. B validates provenance, completeness and consistency; employee recollection or an unexplained spreadsheet is insufficient. A final certificate may follow the actual exit, so validate pre-exit figures and a final-document handoff first. Reconstruction does not discharge A's document duties.

If essential inputs cannot be validated sufficiently for the mechanism, filings and payroll, do not pass the gate. The client seeks a lawful extension with A or defers the exit and B's start; continued work requires valid employment, arrangement and permission. Keep unresolved balances open and assign escalation. Never create two live payrolls to compensate for missing records.

Follow the Belgian DPA's processing principles and personnel-file guidance: define lawful purposes, necessary fields, worker information, authorized recipients, secure transfer and appropriate retention. A signature does not authorize copying every medical or dispute file.

Two employee situations that change the switch

Hypothetical: independently authorized worker

For the Belgian worker above, the conditional outcome is a 30 November agreed exit and 1 December start only after the 27 November gate. A's November wages and EUR 600 holiday component remain A's payments; B's December pay includes EUR 200 for that four-day component. The employee reviews the documents and checks December's actual payslip.

If classification instead establishes a CBA 32bis transfer, replace the exit/new-employment mechanism and reassess the settlement. Contractual recognition alone cannot reproduce every statutory service, pension or time-credit consequence.

Hypothetical: employer-linked permission

For another worker proposed for 1 December, assume B has not established the lawful employer-change start date. Defer the switch while B resolves the applicable authorization, notification or exception, including relevant EU-law rights. Continue with A only while its employment and permission remain valid. A proposed payroll date, signed offer or unexpired residence card cannot fill a work-permission gap.

Questions about switching EOR in Belgium

Must the employee sign a new contract?

A qualifying statutory transfer continues the existing contract automatically. A genuine exit/new-employment route requires its own agreed documents. A platform change may leave the legal employer unchanged.

Can the new contract preserve all previous service rights?

Specify each recognized purpose. Contractual recognition does not alone continue an authority-approved leave arrangement or every pension/benefit condition.

Does changing providers restart probation?

Ordinary contractual probation is generally unavailable following its 2014 abolition. Special temporary/agency and student regimes need separate analysis; a provider change creates no universal reset.

Does switching restart an assignment limit?

Assess the permitted route, purpose, duration and assignment history. A new intermediary's name is insufficient evidence of a fresh permitted assignment.

Can the deposit refund fund B's first payroll?

Only if the money actually arrives before B's agreed funding cutoff. Budget independently for any timing gap and reconcile A's supported deductions.
