Key Takeaways

  • Determine whether employment continues with the same entity, section 6b applies or lawful fresh employment is needed before signing exit documents; unchanged work does not establish statutory continuity.
  • A provider change does not restart the covered client-assignment clock. More than 24 months within 36 at the same operating unit can trigger an offer-or-compensation duty, subject to applicable exceptions and agreement variations.
  • Holiday rights follow the legal mechanism: a qualifying transfer preserves them, while an ordinary fresh exit generally requires compensation. Do not carry the same settled liability into B's payroll.
  • Complete negotiations, required agreement, verified records, benefit acceptance and funding before cutover. Permit-specific rules can allow a qualifying pending-application start, but filing alone does not establish every worker's eligibility.

To switch employer of record providers in Sweden, establish who employs the worker today, who will employ them afterward, and which legal mechanism connects those relationships. An unchanged role and a new payroll account do not establish statutory continuity.

The answer determines whether existing employment transfers, whether fresh employment documents and a lawful exit are needed, and who carries holiday liabilities. For client-controlled agency work, the assignment history can also create a duty for your company that changing providers does not remove.

What changes when you switch EOR in Sweden?

Compare the legal names and organisation numbers on the employment agreement, amendments and payslips with the incoming employment documents. Identify any local partner behind the service brand. Registration confirms identity; it does not prove that a business transfer exists.

SituationLegal mechanism to verifyEvidence requiredImplication
Service platform changes; employer remains the sameContinuing employment with amended administrationSame employing entity; service scope and benefits changesKeep employment running; update relevant arrangements

Different unrelated employers; no qualifying transferFresh employment plus a separately lawful ending with EOR ADocumented mechanism assessment; EOR B agreement; A's exit processSpecify recognition and settlement item by item

Sweden's Employment Protection Act governs section 6b transfers. A supplier change alone is insufficient: the EU transfer test examines an economic entity retaining its identity. The Jouini judgment shows that temporary-work businesses can qualify on their facts. Neither the EOR label nor continued work for the same client decides the result.

Have the employers document the classification before asking for a resignation, termination agreement or replacement contract. A disputed classification changes the proposed route and date. If the worker instead resigns unilaterally, LAS normally requires at least one month's notice; employer dismissal has its own grounds, notice and process. Check the applicable agreement before fixing either date.

Review the existing service and employee position

Your commercial notice ends a service arrangement. It does not itself end the employee's contract or settle the employer's liabilities.

Commercial agreement checklist

  • Identify the contracting supplier, actual employer and any subcontractor; obtain written authority for the handover.
  • Check service notice, renewal, exit fees, transition assistance, funding, deposits, refunds and surviving indemnities.
  • Record payroll cutoffs, invoice dates, retained-record access and responsibility for corrections after exit.
  • Confirm how an extension works if employee arrangements or incoming readiness are delayed.

Employee arrangements checklist

  • Collect the contract, amendments, original service history, current pay, variable-pay rules and any dispute or protected leave.
  • Identify collective-agreement coverage, union-negotiation requirements, probation status and employment notice.
  • Verify permission to work, any employer restriction, pension and insurance coverage, approved leave and holiday balances.
  • Agree final and first wage periods, payment dates, lawful records access and employee contacts. Check bonus and equity separately with the plan issuer.

Union negotiation can be required before the relevant employer decision. The Co-Determination Act makes the employer's agreement position and affected unions material; an employer without a collective agreement can still owe negotiation duties on a business transfer. A covered client's decision to engage supplied labour can require its own process. Schedule these duties before decisions are implemented.

Establish transfer and continuity treatment

Create a signed treatment schedule alongside the legal mechanism assessment. Distinguish statutory rights, expressly agreed improvements and amounts A must settle.

Bonus and equityContract, plan and transfer treatment determine the obligationIdentify earned sums, payer, vesting and any required issuer consentA, B, client and plan issuer
Work permissionActual permit category and employer restrictions controlEstablish lawful work entitlement for B before work beginsB and employee

Under the Annual Leave Act, section 31 protects holiday rights in a qualifying section 6b transfer. For an ordinary fresh exit, sections 28 and 30 instead provide holiday compensation, normally payable without unreasonable delay and within one month after employment ends. Check permitted collective-agreement variations and calculation exceptions. A spreadsheet balance cannot choose the legal route.

Check the client's assignment clock

The Agency Work Act applies to workers employed for assignment under a client's direction and control. Under its default section 12a rule, placement exceeding 24 months within 36 at the same operating unit requires the client to offer indefinite employment or pay two current monthly salaries within one month of exceeding the threshold. Check statutory exclusions and qualifying collective-agreement variations.

Track the worker's placement across suppliers. A new EOR does not provide a fresh client-assignment clock. If the threshold is near, settle the client's obligation alongside the switch; the migration cannot substitute for that decision.

Set one coordinated cutover calendar

The following hypothetical case uses a Swedish citizen who already works in Sweden. Assume unrelated EOR A and EOR B, a documented assessment that this arrangement falls outside section 6b, no applicable agreement variation, and a freely agreed lawful end with A followed by indefinite employment with B without probation. If the facts support a statutory transfer, replace this fresh-employment route. The Labour Court recognises binding agreed endings but examines invalidity and improper employer pressure; a signature does not cure an unlawful process.

The proposed effective date is Tuesday, 1 December 2026. Assume the commercial contract permits service exit on 30 November with at least 30 calendar days' notice, acknowledged on Friday, 30 October. Those dates are 31 calendar days apart. This is service notice; it is not employee notice. Assume the service terms and employee agreements expressly allow the end and start dates to be deferred together if final readiness fails. A remains the employer under that agreed contingency.

Payment dates and operational cutoffs above are assumptions. Skatteverket's calendar supplies the illustrated reporting dates for employers with turnover at most SEK 40 million. Above that threshold, the return dates differ: check filing and remittance separately.

The example brings first pay forward by agreement because Sweden's holiday calendar places Christmas Eve on Thursday, 24 December and Christmas Day on Friday, 25 December. Confirm the bank's actual processing cutoff. The 23 December pay date is not a national statutory payday.

Reconcile transition costs and cash

Keep A's closing liabilities separate from B's new funding. A refund expected after reconciliation cannot fund B's payroll unless it has actually arrived and finance has allocated it.

Fee, liability or funding itemWhen dueResponsible partyRefund or settlement treatment
Service notice, exit or implementation feeActual contract datesClient under service termsVerify liability and any agreed waiver; no assumed market charge

B's first payroll and benefits fundingB's accepted funding scheduleClient funds; B administers/payroll paysInclude approved employer charges and fees, beyond gross salary

For the worked case, assume A's payroll has lawfully calculated SEK 9,000 for older outstanding holiday entitlement plus SEK 3,000 for the remaining accrued entitlement. These are illustrative validated ledger inputs, not statutory day values or a universal calculation formula:

SEK 9,000 + SEK 3,000 = SEK 12,000 gross holiday compensation, paid by A on 30 November. B imports the settlement reference and carries SEK 0 of that settled liability. B separately establishes the worker's new holiday entitlement and any agreed leave arrangements. A must explain how a planned holiday will be funded after the switch; an old cash settlement does not itself create paid leave at B.

The SEK 12,000 excludes wages and employer charges. Payroll determines the proper withholding and contributions; no net-pay outcome is assumed. On a qualifying statutory transfer, the example's payout treatment changes to the applicable preserved-rights arrangement.

Test the first payroll and close the old arrangement

Use a calculation-only comparison before releasing B's first wages. Differences need explanations, especially where A's terminal payment and B's ordinary salary have different withholding treatment.

  • Pass: periods and payer. A owns 1 to 30 November wages; B owns 1 to 31 December wages. Each live payment has one releasing employer.
  • Pass: historical values. Identify A's year-to-date earnings, tax, benefits and holiday settlement as history. Do not import them as B's new earnings or payroll funding.
  • Pass: tax setup. B verifies employer registration and validates employee identity, tax instructions, withholding method and contribution category. A's net pay is not the target result for B.
  • Pass: benefits. Obtain written confirmation of A's coverage end and B's coverage start, pension treatment and any waiting-period solution.
  • Pass: balances. Match A's SEK 12,000 gross holiday settlement to its payslip, payment and zero unsettled balance for that item. Confirm B's separate holiday record.
  • Pass: filings and cash. Match each employer's monthly declarations to its actual payments and benefits. Retain submission receipts, invoices, refund records and an owner for corrections.
  • Fail: unexplained variance or missing decisive evidence. Resolve before irreversible exit or cutover; do not substitute two live wage payments for a test.

Skatteverket's reporting rule follows the payment/benefit month, so A can retain filing duties after employment and commercial service have ended.

Give the employee a usable handoff

In this example, provide the employer names, mechanism, comparison of statutory and agreed rights, proposed pay/benefit dates and holiday treatment before the 12 November gate. Explain B's contractual service recognition without promising statutory continuity. Send final documents with time for questions before the proposed 13 November conditional signature; that review timetable is assumed, not a universal statutory consent deadline. Name A's payroll contact, B's onboarding contact and the client's escalation owner.

If A delays or refuses records, the client transition lead escalates to A's accountable owner. B payroll identifies minimum verified identity, work entitlement, contractual pay, tax instructions, current benefits, relevant service/leave history and settled/open balances. Reconstruct only through lawful, reliable records that B validates as sufficient. If they are insufficient, invoke the agreed deferral and extend A's arrangement before employee exit; do not invent balances or promise work through a permission gap.

IMY requires necessary, accurate data and appropriate access protection. Establish the disclosure basis, authorised recipients, secure transfer and retention duties. Consent to employment documents is separate from the GDPR legal basis; employee consent is normally unsuitable as the basis for employer data processing.

Two employee situations that change the switch

Hypothetical case 1: independently authorised worker. The Swedish citizen in the worked calendar can start with B on 1 December if the documented non-transfer route, voluntary exit, benefits and payroll gates hold. A pays the SEK 12,000 holiday balance once; B funds and pays its December payroll separately. If the transfer assessment changes, revise the rights and settlement documents before signing. Existing client-assignment history still needs checking under the agency rule.

Hypothetical case 2: employer-linked permission. Assume the same work and proposed date, but a non-EU worker holds an ordinary permit restricted to A and the occupation. B must establish its actual employer eligibility and the worker's change-employer route. An organisation-number change can matter even when the client and job are unchanged.

Read the decision, not just the card's expiry. The Aliens Act ties ordinary permits to employer and occupation during the first aggregate two years, then generally to occupation. The Migration Agency guidance recognises starting after a required new application is submitted before the old permit expires, subject to the applicable conditions, including prior advertising. The Aliens Ordinance, chapter 5 section 3, contains a conditional pending-application exemption, including a route for an application after the previous employment ends while the permit remains valid. Match the actual filing sequence to the applicable legal basis. A blanket instruction to wait for a decision would miss this route; filing alone does not establish eligibility for every worker or EOR arrangement.

For this second case, keep 1 December conditional until the specific entitlement to work for B is established. Check current salary, insurance and employer requirements, applicable transition rules and required notifications. B must distinguish starting the online process from the employee completing the application. The current employer guidance requires at least ten days of advertising before the employment agreement. It contemplates staffing, without approving every nominal-employer arrangement. The June 2026 changes also make application timing material; confirm whether an employer-change application qualifies for any extension transition rather than assuming it does. EU Blue Cards and other categories have different conditions. If B cannot support the arrangement or a lawful start cannot be established, defer the switch and resolve an eligible employment route before A's employment ends.

Questions about switching EOR in Sweden

Must the employee resign?

Determine the mechanism first. A qualifying statutory transfer continues employment subject to the objection right. Outside it, agree B's employment and a lawful A exit; resignation is not the default migration document.

Can the new contract preserve the original start date?

It can record agreed service credit. The employers must separately establish statutory continuity and specify which contractual entitlements use that date.

Can accrued holiday simply move to B?

The mechanism decides. A qualifying transfer protects statutory holiday rights. An ordinary fresh exit generally requires A's compensation settlement; document any legally available alternative before moving a balance.

Does switching reset the agency assignment limit?

Track the person's placement at the same client operating unit across providers. Do not restart the section 12a record because B issues the next payslip.

How long should the switch take?

Use the latest binding dependency: lawful employment arrangements, negotiations, permission, records, benefits or funding. The worked dates illustrate a conditional plan, not a standard migration duration.
